reply came from councilman austin that it was because rogers was out of the vote to confirm the new appointments wa staken air powers voted no following is a list of the new officers for the fire read from city attorney Attorn oy devine touching the question of the legality of the confirmation fir of the appointees to positions as jailer and desk sergeants at police station made by the city council at its previous session in the opinion of attorney devine the appointments were illegal and to support his opinion he recited the statutory provision number of the revised statutes ot the state and he also referred red to the sheets case of salt lake wherein the same question in his opinion was involved and in which case an opinion was handed down by the supreme court of the state the supreme court decision declares that the confirmation fir of sheets appointment was illegal sheets confirmation as in the ogden matter under consideration was made only by a majority vote of the members of the council present the court of last resort maintains that in the confirmation of a salaried officer of the city a liability is incurred and that 11 can be done only by a majority vote of the council elecie d the attorneys opinion was accepted and ordered placed on file no comments were made by members of the council on the lawyers opinion regarding the matter but the council moved on to other business 1 the question another accountant to city auditor in rearranging the records was referred to the law committee for action reports of various were accepted and filed without abw particular action on the part of the council as a whole ahe committee on streets to whom had been referred the petition of certain citizens on twenty fourth street asking the council to it it possible that the dearig in the street and around the hew federal building on the corner of street and grant avenue he removed reported that they had made a careful investigation vesti gation regarding the matter and found that the contractors franchise to use the street in the construction of the federal building had long since lapsed and ac was recommended that the said contractor be notified by the city recorder to remove such obstructions as may be found on the premises in question that are there by virtue of his operations the contractor will be admonished to attend to this matter immediately city on last years account the matter was referred to the committee on taxes A communication was read before the council setting forth the fact that elsie mann had been appointed and conformed as the because of the injury alleged to have absen sustained by a team of horses while they were being driven on the city thoroughfare at tho crossing of the north ogden canal it appears that the horses were ih aured while attempting to cross tha bridge the attorney was instructed to go ahead and exercise his talents in defense of cites rights being by the attorney that it bould be illegal for the council
