Show TO GRADUATES attorney general bawden renders an opinion upon an important subject according to an opinion rendered tuesday by attorney general breeden the state baird of education has no authority to eosue sue licenses to graduates from certain schools not under the supervision af pf the state board legally qualifying them to hold positions in our public schools the opinion was writ tenn answer to a query from state superintendent of schools nelson and the general gives his reasons for the opinion in the following language under the custom laws of this state the jurisdiction of the state board of education Is confined conr ined exclusively to the supervision management and control of the system of schools known as the public free schoola of the state the laws enacted by the legislature of the natate relating to tho powers and duties of the state board of education relate wholly to its powers and authority over the public schools of the state chapter 71 session 1905 authorizes the state board to arant a certificate of qualification to teach to such applicants who have previously been examined by the superintendent of their respective counties under the authority of tho state board and have been found up to the requa bd standard of scholastic attainments and aptness and ability to teach the state board must authorize the county superintendents of schools of each county in the state to hold examinations and these superintendents must hold these examinations be tore the state board is authorized to issue a certificate of qualification prom this brief discussion of the question submitted you are advised that the state board of education Is not authorized and haa no power to legally issue certificates to persons to teach la our public schools until the requirements of section 1 of chapter 71 session laws ot 1905 have been complied with |
