Show w RAILROADS ARE SUED FOR LOSS OF SHEEP In Judge Harris' division of the district dis-trict court this morning, tho Jurymen for the August term were called and all except one wore on hand. It was stated that Stanley Dec, the absenteo, was out of the city. The court did not order the issuance of a bench warrant, it appearing that there wao Just excuso for the juror not appearing appear-ing to answer roll call The case taken up for trial was that of Louis Bltton against the Southorn Pacific and the Oregon Short Lino companies, to recover ?17n alleged to bo duo an damages done a herd of sheep shipped over tho road6 of the two companies In April, 1911, tho complaint alleging that thlrty-nve sheep were destroyed while in transit because the company did not properly "bed" or "sand" the cars in which 400 head of sheep wore shipped from Col-mar Col-mar to Hyrum The plaintiff claims that neither bedding nor sand was placed on the floor of the cars while the 400 aheap were transported between tho two stations, the result being that 35 head died. The defendant company, In thoir answor to the complaint, deny that the loss of 35 head of shoo was occasioned oc-casioned by tho failure of tho company com-pany to properly bed the cars, and thej claim that tho plaintiff well knew the condition of the cars whon the ehipraent was made, he bolug guilty of negligence as well ns tho railroad companies, If tho failure to bed the cars should be considered negligence. |
