OCR Text	Show CASE IS WON IN) THE HIGHER COURT In Judge James A. Howell's division divis-ion of the district court this morning morn-ing was taken up tho appeal case of Ogden city against George Allen. Allen Al-len having been charged in the municipal muni-cipal court with disturbing the peace A verdict was given against him In tho lower court and he was sentenced to a fine of $100. The allegations are that on August 15, 1912, the. defendant accosted James E. Schainck with a revolver and threatened to blow off his head. Allen thinks the verdict of the lower court was unjust and that ho should have been acquitted. Tho hearing of tho case was hurried, hur-ried, the court not taking the regular noon intermission Shortly before '2 o'clock the jury rendered a verdict of not guilty. Mr. Allen was released from further obligations to the cltv
