H It will be remembered that when HHI tho city undertook to p'ace the con- HHI duit over the property of Mr. Badger H and co-owners, injunction proceedings H were instituted and the city was-com- Hll polled to begin condemnation pro- H ceedings and get an order from Uic HH court giving them possession ot the HHI premises. At that timo it seemed HHI that a settlement, except one that HHJ might bo dictated by the court and H jury, was impossible and tho matter HR was ready for trial when another ef- H fort at settlement was made, tho re- HH suit being that an agreement was HH reached and tho matter settled wlth- HHj out further litigation. In tho uiean- HHJ timo the conduit was laid HH In their answer to the condemnation HH gomplaint filed by the city, the dc HH fondants claimed that the digging of HH the conduit over their lands ''would HH have a tendency to undermine their HH lime kiln and cause the ground to HH cave in and, also, that in the blasting HHJ for lime rock the plaintiffs would he HH in constant danger of damaging the HHI conduit.
