The only known eye witness to the shooting of Charles A, Patter- son, for whose murder his wife, Gertrude Gibson Patterson is 4- 4- now on trial before Judge George W. Allen in tho district 4- court, was placed on the stand today. He is A. B. Shugart, a carpenter, whose home Is near tho spot where Patterson was killed. t On tho morning of Sept. 25 last, ho testified, he was coming out of a shed In the rear of his home when ho heard two shots fired In rapid succession. suc-cession. "When you turned the man over, did you find anything?" asked Special Spe-cial Prosecutor Horace G. Benson. "I found n revolver," Shugart replied, re-plied, and identified the weapon with which Patterson was killed. Young Artist on the Stand, George W. Strain, a young illustrator illustra-tor of Denver, told the jury of events at Mrs. Patterson's bungalow on the Saturday night preceding the shooting. shoot-ing. As he was leaving. Strain said, Mrs. Patterson asked him to leave his revolver, which he did. He identified the weapon with which Patterson was killed as the one he had left with Mrs. Patterson. Called Husband on Phone. Witnesses were introduced to show that Mrs. Patterson had called her husband on the telephone at the sanitarium san-itarium on the morning of the shooting, shoot-ing, that he had answered, "I don't ever want to see you again," that she had waited for her husband; that when Patterson saw her, he started to run away and that later the two walked off together. Physicians who conducted the autopsy auto-psy on Patterson's body testified that he had been shot twice In the back, one bullet entering just under the right shoulder blade and passing through his shoulder and the other entering just under his left shoulder blade and passing through his heart. The second wound caused his death, they said. |
