Show Disaster Has Re-Call When. Richard J. Armstrong, former Butte man, was killed in a cave-in at the Utah-Apex mine October 16 last, his widow applied ap-plied to the Utah Industrial board for compensation. At the same time another alleged widow wid-ow of Armstrong's, Mrs. Berdel-la Berdel-la Armstrong, of Butte, maintained main-tained 'that she had a right to the compensation. Hearing of the story of the Butte claimant will be held here tomorrow before be-fore Commissioner W. M. Knerr of Utah. Mr, Armstrong, a timberman, 51 years of age, had been married mar-ried at Farmington to a Salt Lake woman two weeks before the fatal accident at the Utah-Apex Utah-Apex mine last summer . When the recent bride presented her claim for payment under the compensation act, the former Mrs. Armstrong of Butte also presented a claim; bne coniena-ed coniena-ed that she had. been married to Mr. Armstrong many years ago and he is the father of .their daughter, 17 years old, who is living with her mother at Butte. Subsequently ' there was a divorce, di-vorce, but it is Mrs. Berdella Armstrongs's contention that a remarriage followed the divorce, and that she was therefore, legally le-gally Mr. Armstrong's wife at the time of his death.' Accompanying Mr. Knerr to Butte was E. L. Heamey, claim agent of the Aetna Life Insurance Insur-ance company, which carries the insurance on the Utah-Apex. |
