Where there is no dispute the decision must be unanimous. L 2. In all cases of dispute between nations, neither party to the dispute has any vote in the fll decision. H Decisions of Disputes Between Nations St Article 15 of the Iieague provides in detail for the decision of 'disputes between nations, and WKr states clearly and emphatically that each nation which is a party to the dispute shall not have jfl "' any vote in the decision. ' flL The Council and the Assembly (as the one or the other may hear the dispute) is given tho power to decide whether the matter in dispute is within the domestic jurisdiction of one of the SI nations to the dispute, or whether the matter is an international one; quoting from the League, SI "If the dispute between the parties is claimed by one of them, AND IS FOUND BY THE H COUNCIL, to arise out of a matter which by international law. is solely within the domestic m jurisdiction of that party, the Council shall so report, and shall make no recommendation as to M its settlement." The present dispute with Japan will illustrate how the matter would be han- M died if we were a member of the league. The United States would, of course, claim that it is a H domestic question whether the Japanese shall be permitted to hold title to real estate within the 1 United States; but the LEAGUE WOULD HAVE THE POWER TO DECIDE that the dispute S was an international one and say that the United States MUST permit the Japs to own land in H ' the United States. And, of course in the making of such a decision the United States would not B have any vote.
