Show Jury in Deadlock; Eleven in Favor of Coloneljoosevell Twelfth Would Agree to Verdict for Defendant With Costs Divided Syracuse N. Y., May 21.1 Tho 3 Jury In tho trial of William Dames suit for llbol against Theodoro Rooso-velt Rooso-velt was deadlocked tonight, after onco having returned a conditional verdict In favor of tho former president presi-dent which Supremo Court Justlco William S. Andrews refused to ro-celvo. ro-celvo. Tho conditions which mado tho verdict nn Improper ono was that tho trilling court costs and disbursements disburse-ments should bo divided between tho two principals in tho action. That tho jury would bo hold over until Monday, should it fail to find a propor vordlct by tomorrow, wits considered improbable by attorneys connected with tho case Tho deadlock was tho result of juror jur-or No. 11 Edward Burns, a Syracuso motorman and a Republican announcing an-nouncing in substanco that It tho sosts and disbursements were not divided di-vided ho favored a vordlct for tho plaintiff. Tho jury was in court twice today. Soon after Justice Andrews arrived this morning ho received a note from tho Jurors informing him that a peculiar pe-culiar situation had arisen, and asking ask-ing that ho confer with them in tho jury room. Justice Andrews had tho Jury brought into court and informed inform-ed them that any thing ho could do to aid them In reaching a decision deci-sion must bo done in open court. Tho Jurors whispered among themselves them-selves and then requested that they I bo allowed to return to their room for further deliberation. Nearly an hour afterward word camo from tho Jury room that a decision de-cision had beon reached. In open court tho foreman Warren W. Som-mors, Som-mors, a grocer, announced nlmost in a whisper that a vordlct had been found for tho dofendant. Tho spoctatois started for tho ex-Its. ex-Its. Then Mr.. Somors, In a volco that could not b'o heard' at tho far sldo of tho courtroom went on to say that tho verdict w-as for tho dofendant do-fendant upon tho condition that ho v pay half and tho plalntlf pay halt --J tho costs.
