Is Advised By Court Judgo IMtchlo advised Chrlstonsen that ho had been asked to testify as to his actions In d folony case nnd told him that ho had tho right to re-fuso re-fuso to answer any question that may tend to Incriminate him. Attorney U. A. Walton of tho defenso suggosv ed that tho court appoint a lawyer to caro for Chrlstcnscn's Interests and to advlso him so that ho protect himself. Mr. Farnsworth, for tho state, offered no objection to this. Christensen said that ho had nl-ready nl-ready talked with his lawyer about tho matter, and was fully advised as to what ho should do. Ho declared that no promises had been mhdo him for giving his testimony, and that ho understood fully that It was a felony for him to attempt to break Jail. "And who else, If anyono tried tho mnsonry?'' was the noxt question. "Inlow tried it." Christensen said that tho Insldo j gate had been locked with two big padlocks nnd it was very dark In tho bathroom. Ho nsked tho Jailer to open It n little so they could seo to do some washing. Tho Jailer tried tho next day to open tho locks, but ono would unlock nnd tho other would not Chrlstcuscn nnd Inlow saw that ono of tho locks had been tampered with. Considered Way To Escape The) began to tilk of the Jail break i hen, Christensen snld, nnd ho agreed with inlow that they could probably make tho break If they could get tho ight kind of tools. Christensen suggested sug-gested a sharp tool llko a chisel. Ho-,')lug Ho-,')lug to questions, ho snld: In the meantime wo did n lot of work with n sharp pleco of Iron llf- ' teen Inches long, which w0 nicked ' IKo ii saw, so wo could saw at tlio no tar with It We worked a lot at I, and tho next dn) another J. l.v cinio up and locked tho door nnd ' wo could do no moro with It for mo oi threo da) 8. . I 1 suggested that wo drop it, una i , told Inlow that when I went out I 'ant"i ;o go cut rlgl-t free lio Miggcsted thnt We get tho tool3 and !o nhehd. I snld I did not inro much, but that I'd help him All of n sudden a key showed lint would unlock ono of tho !o ks It was In Inlow's possession V'o v locked ono of tho locks, but It would not unlock tho other. Wo wanted files for the lock we could not open with tho key Then tho flics show oil up In Inlow's possession. . Wo took turns nt filing creases In tho padlock nnd b putting a pocket kiilfo blado nnd n piece of wlro In tho tiling wo could press the tumblers back and unlock It. Started Two Weeks Ago Wo first started work cm tho lulcks as near ns I can remember, about two weeks ago. Last Thursday night In-low In-low was thoro sawing nnd pr)lng at tho bricks Ho told nio that ho had a brick partly sawed througn so ho could get tho pliers under It, nnd that ho foigot himself nnd pried with both hands Instead of with ono hnnd and protecting tho brick from fnlllng with tho other hand. Ho said a brick fell out Ho ran Into tho coll nnd cried: "My Clod, 1 guess wo nro up ogalnst It Now seo what I hnvo dono It stopped Just n second on tho edgo nnd I couldn't stop t What will wo do?" I told him thero was nothing wo could do but to make a clean brcudt cf it. I told him we ought to mako an open confession. Inlow proposed that we seo If we could fix tho bricks In any way so that they would not be seen. I told him that they wero not fools, and that they had tho best Jobs In town, and wero shrewder than wo wero. I got plumb disgusted and heartsick at what had happened. I left him and went to bed. I don't know what itlnd of shape ho got thorn in pretty good, I guess. On the following morn Ing I was taken down to th0 tier "Aro you still down In tho tier?' asked Mr. Parnsworth, "No, I'm In tho courthouse," Christensen Chris-tensen answered, quick as a Hash. Offer Locks In Evidence Tho state then offered In cvldcnlo a miscellaneous collection of hardware. hard-ware. Thero wero two Jail locks, ono of them worn smooth on ono side, whero tho lettering "Pauly Jail company," com-pany," had been rubbed off with in-llnlto in-llnlto labor by grinding t against tho coll wnll. That wag tho lock which had been smuggled out of the cell to n locksmith, and then omugglod back with a koy that would open It. Thero was a pair of pinchers, h screw driver, four metal strips taken from tho bunk In tho cell ana ono long strip of metal. Inlow claimed all the tools ns his own Chrlstonsen said, Tho prisoners filed ono or tho bars, too, but broke the files Into small pieces with tho pinchers and flushed them Into tho sower when they found that tho files would not cut tho steel bars. Christensen said that the files wero In Inlow's possession when ho first saw them. Ills cross examination will bo taken tak-en up this morning by tho derenso. Demosthenes Demos, a Illngnnm druggist with whom Mrs. Inlow traded, trad-ed, a now witness whoso, namo had not heretofore appeared In tho case testlllcd that on the night of October 4, 1012, h0 enmo to tho city and went to .Murray to attend h boxing match. Ho returned to tho city about It. 35 o'clock or 11:10 o'clock nnd while passing tho National Dank of tho Republic Re-public saw Mrs. Inlow standing near tho bank entrance. Ho turned to see If sho had seen him, as ho had raised his hat to her. Sho did not seo him She wore a dark or black coat. Ho was posltlvo In his Identification. Identi-fication. Inlow's Revolver Introduced 'iho point nt which Demos said ho saw Mrs Inlow is across tho street from Whlto's regu'nr stand nnd nenr his telephone box. Tho stato Introduced ns exhibits tho revolver and scabbard nnd cartridges car-tridges found in Inlow's grip, tho woman's wo-man's black cent and tho man's black coat which have tuken such I prominent places In the case I Hansom Usher wns called by the defenso for cross exam mmou. Ho Is street enr conductor who testified t nt Mrs Inlow boarded a h enr at Stato nnd Ninth South streets the night of tho murdci . 1 he deXnso tried to tanglo him as his tcstluun at tho preliminary hearing. "Is your recollection ns to human faces any better than that cf your testimony nt tho prellmlnn y tearing?" tear-ing?" asked tho defcn3o "In somo cases, )es sr" Usher answered , Charles II. Whlto, brother of T H. Whlto, the victim was recti, led to tell of tho lighting sjstem used on tho enr. T. K. Whlto wns tho drlv-or drlv-or of tho car tho night he was kill ed. Tho witness was also asked concerning con-cerning his brother's p Ivato llfo. "Was tho keeping houso?" nsked Air. Walton. This was objected to bj tho stato as Immaterial and tho jvlefenso said that thoy v anted to show tho lntl mnto sido of White's llfo and what Whlto was doing that night. Tho court refused to permit the witness to nnswer questions concerning his brother's family llfo or personni nf fairs James ,. Johnson who relieved Eddie Ed-die Whlto on the night or tho murder mur-der so that Whlto could go to tho boxing match said that Whlto return-at return-at 11 30 o'clock to tho car Johnson told also of tho lighting arrangements in tho car. County Physician Testifies Dr A il Hansen, county physl-c physl-c nn brother of Wlllard Hansen of counsel for tho defense, testlllcd that It wns his opinion that tho bullet that killed White was a .38 caliber steel bullet. Dr. Hansen said that ho did not believe that tho fatal wounds of tho character inflicted on whlto could havo been inflicted by the revolver exhibited by tho state tho ono found in Inlow's grip. E. A. Vandeventer, managing editor edi-tor of Tho Evening Telegram, testified testi-fied that lato in September or early In October Inlow had tried to prevent the publication ot the story of his arrest on a burglary charge. Inlow represented himself as a Bingham business man and a friend of Inlow. Inlow declared that the arrest arose from a mistake In identity and that Inlow was innocent and that the case would nover come to trial. Tho declaration by Inlow that ths case would never come to trial was held by tho court, on tho defense's objections, to bo too remotely cc nected to havo bearing on the case and all of Mr. Vandeventer's testimony testi-mony was stricken from tho record. 8uggest Possible Motives The stato made its first effort during dur-ing the trial yesterday morning to show a possible motive tor the murder mur-der of White. Tho facts brought out concerned the arrest pt Inlow on a chnrgo ot burglary In tile third degree de-gree and that Thomas Eddlo White the chauffour who had driven Inlow to tho scene of tho burglary with which ho was charged, had told the police of his suspicions and had been tho cause of Inlaw's arrest. Stato Chemist Herman Harms was recalled and said that the bloodstains on tho coat were not moro than ten days old when he made the analysis. He said ho had found no Indications of blood on the revolver, but that dark stains on tho weapon wero of rust. U. L. Hddlngton, a deputy sheriff testified that he had been unable to servo a subpoena upon former Patrolman Patrol-man Joo Downey, Mrs. Dello Lang-stron, Lang-stron, Downey's mother, testified that ho Is In McGIII, Nov.
