Pedersen's court. After a telling argument by the de- M fendauls attorney, A. A. Law, as to M the merits of the case, the judge or- M dcred the case dismissed on the H grounds that no criminal intent was H committed and that the ballots were H not taken with malice or to commit a H felony IH Some arc more or less familiar with iH the details of the case, but for the 'H benefit of others we present the fop jH lowing Incidents: H A few days bcfoie the last gencial election, Messrs Parkinson and Israel- jH son, President and councillor of the iH Hyrum Stake, attended ward services H of the Mt. Sterling district. While , there they weie tin; guests of David 'H Murray who, as was brought out in 'H the preliminary hearing, was one of ,H the judges or election. In the course 'H or their visits some otllcial .ballots H were taken. - H On election morning one, Hubert 'H Baxter, a democrat, being the first voter at the polls, and noticing some ' H of the ballots being gone, casually ask- ' H ed where they were. In the course of H the day he saw W. 0, P.iikiusou who H gave him a package addressed lo Mr. J Murray, and In the same Mr. Baxter H saw one of the missing ballots. Upon H further Investigation lie found the t H other ballot .In the possession of Mr. H The men were arrested at the Insti- , H gatinu of one Owen, charging them H with u violation of the election laws. H The piosccution was conducted by H Attorney Waiters and the defense was represented by Attorney Law, with M the result as above stated. (. H |
