Show Not Guilty Plea Entered By Woman Mrs. Grace Coppard Gains Time In Murder Trial At County Court House Here With the overruling of a demurrer demur-rer Which was filed by defense attorneys, at-torneys, Mrs. Grace Coppard of Soda Springs appeared before District Dis-trict Judge Jay L. Downing here Wednesday and entered a plea of not guilty when charged with the murder of Paul Tipton, Soda Springs garage owner, last August 23. Judge Downing scheduled the trial to start February 24 ac 10 a. m. He ordered 50 veniremen to be called from Franklin county to act as a list from which the jury will be selected. Brought out also at yesterday's hearing was the fact that three new witnesses had been found by the prosecuting" attorney R. J. Dygert, of Pocatello. The court has permitted these witnesses witness-es to be used by the prosecution when the trial begins. The case originally was set for hearing January 16, but defense attorneys filed a demurrer on the ground that Caribou C o u n ty Prosecuting Attorney R. J. Dygert had no legal right to file an amended amend-ed motion outside his own court. Judge Downing granted the defense de-fense 12 days to file a brief, the state's attorneys three days to reply re-ply and the defense three days for a counter reply. That period expired last Tuesday. In his announcement Monday, I Judge, Downing said the delay was causcl by further deliberation on the demurrer which he overruled. The trial how is scheduled to pro-ced; pro-ced; in regular order. She case is being tried in Preston under a change of venue granted to the defense. Attorney General Bert Miller has indicated he will assist in the prosecution. j Mrs. Coppard, accompanied by her husband and her mother, Mrs. C. N. Shelton of Pocatello, was calm when she appeared before Judge Downing. |
