The defendant, represented by that able follower of Blackstone, David Evans of Ogden, appeared at the hour set, 5 o'clock Monday, and demanded trial. " The plaintiff asked for time and the case was postponed until 8 o'clock p. m. The court opened at 8 and box attorney asked for still more delay. de-lay. The case was then postponed a second time to 9:30 next morning. At this session box attorney at-torney still asked for a continuation continua-tion for a week or more. Attorney Evans, by this time thoroughly out of patience, then got up and riddled the defective paper with well chosen and faultlessly aimed legal bullets, and the request was overruled by the court; but box attorney at-torney was still given a third postponement post-ponement until 2 p. m. At this hour box attorney appeared and coolly aked to have the case dismissed, dis-missed, which was done at his own cost. What a ridiculous sight to see the defendant in any case forcing the fight and the plaintiff who begins be-gins the suit crawfishing at every round! |
