Tropic Town on behalf of Color Country Community Housing, Inc. will request the Utah Division of Community Development (DCD) to release Federal funds under Title I of the Housing and Community Development Act of 1974 (PL93-383fand HOME Investment Partnerships Program. Title II of the Cranston-Gonzales National Affordable Housing Act of 1990, for the following Droiect: PROJECT TItCe OF NAME: Infrastructure and housing development for the Bryce Meadows Subdivision PURPOSE OF THE PROJECT: PRO-JECT: To provide water, sewer, telephone, cable, electrical elec-trical power, and natural gas: and to construct roads and housing for the Bryce Meadows planned unit development devel-opment (PUD) LOCATION OR PROJECT: East of North Highway 12 STREET ADDRESS: (to be designated) CITY: Tropic COUNTY: Garfield STATE: Utah ESTIMATED COST OF PROJECT: $3.4 million dollars dol-lars An environmental review for the project has been made by Elaine M. Murphy, Consultant, and Tropic Town and is available for public examination exam-ination and copying at the offices noted below: Tropic Town Office. 40 N 300 V, Tropic, Utah : or Color Country Community Housing, Inc., 321 N. FINDING OF NO SIGNIFICANT IMPACT Based on this review Tropic Town has determined thaf a request for release of project funds will not significantly affect the quality of the human environment and hence an environmental envi-ronmental impact statement will not be undertaken under the National Environmental Policy Act of 1969 (PL91-910). The reasons for the decision not to prepare an environmental impact statement are as follows: - a finding of No Significant Impact lo the natural or human environment. , PUBLIC COMMENTS ON FINDING'S All interested agencies, groups and persons disagreeing with these decisions are invited to submit written comments for consideration by Tropic Town to Tropic Town Office, 40 N 300 W, Tropic, Utah 84776, on or before September 20, 2002. All comments must clearly specify which decision they object to the Finding of No Significant Impact or the Request for Release of Funds. All comments so received will be considered by grantee prior to its taking any administrative action or requesting release of funds on the date listed immediately immedi-ately above. "RELEASE OF FUNDS Tropic Town and Color Country Community Housing, Inc. will undertake the project described above with Block Grant funds from the Utah Division of Community Development (DCD) under Title I of the Housing and Community Development Act of 1974, and HOME funds under the HOME Investment Partnership Program, Title II of the Cranston-Gonzales National Affordable Housing Act of 1990. Tropic Town is certifying certify-ing to DCD that A. Jean Seiler, Mayor, (certifying officer) in his official capacity, consents to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities responsibili-ties in relation to the environmental environ-mental reviews, decision-making, and action: and that these responsibilities nave been satisfied. satis-fied. The legal effect of the certification cer-tification is that upon its approval. Tropic Town and Color Country Community Housing, Inc. may use the Block Grant and HOME funds and DCD will have satisfied its responsibilities under the National Environmental Policy Act of 1969 and other environmental environ-mental responsibilities listed in 24 CFR Part 58. OBJECTIONS TO STATE TOXEASE OF FUNDS- DCD will accept an objection to its approval of the release of funds and acceptance of the certification cer-tification only if it is on one of the following bases: (a) that the certification was not in fact executed exe-cuted by the certifying officer or other officer of applicant approved by DCD or (b) that the applicant's environmental review record for the project indicated omission of a required decision, finding or step applicable appli-cable to the project in the environmental envi-ronmental review process or (c) another Federal agency has submitted sub-mitted written comments pursuant pur-suant to section 309 of the Clean Air Act or Section 102(c) of NEPA. Objections must be prepared pre-pared and submitted in accordance accor-dance with the required procedures proce-dures (24 CFR 58) and may be addressed to: CDBG Program, Division of Community Development, 324 South State Street, Salt Lake City, Utah 84111. The Division of Community Development will not consider objections to the release of funds on bases other than those stated above. All objections must be received by DCD within with-in 15 days from the time DCD receives the request for release V of funds and certification. A. NOTICE OF CLOSURE To Whom it may concern: Because of drought and continued con-tinued trespass by domestic livestock live-stock the existing closure to all livestock grazing in the follow-ingareas follow-ingareas is hereby extended: The Lake allotment. The Soda allotment. The Rock CreekMudholes allotment. These allotments are located in Township 39 through 42 South, Range 5 through 9 East, in Kane County, Utah. This extension of the existing closure will become effective September 1, 2002 and remain in effect for a period of one year. Any livestock found within the closed allotments may be impounded in accordance with 43 CFR 4150.4. A copy of 43 CFR 4150.4 and a detailed map of the closed allotments is available avail-able at the Grand Staircase-Escalante Staircase-Escalante National Monument offices in Kanab, Escalante, and Cedar City.
