The complex is franchisee! by the Friendship Inn chain and is expected to be open by spring. Buff Trail CSiisinged. A U.S. District senior judge Friday issued a formal order partially par-tially dissolving an injunction he earlier placed on a construction improvement im-provement project on the Burr Trail. Judge Aldon Anderson told Garfield County it may immediately immedi-ately begin construction on those portions of the Burr Trail except the section from Boulder to the Blues. When the National Environmental Policy Act requirements require-ments for an environmental assessment as-sessment have been met, either by an environmental impact statement or a finding of no significant impact, im-pact, the county may then apply to the court for complete dissolution of the injunction according to Anderson's An-derson's order. His order stipulated that the Bureau Bu-reau of Land Management has authority au-thority to monitor all construction to ensure that federal interests are protected. Work may not proceed in any area the BLM identifies as potentially poten-tially containing threatened or endangered en-dangered plant species, nor can it proceed in any area containing an identified archaeological site until the site has been mitigated to the BLMs satisfaction. On Nov. 30, 1987, the same court denied the request by the plaintiffs, an environmentalist coalition of the Sierra Club, National Na-tional Parks and Conservation Association, As-sociation, Southern Utah Wilderness Wilder-ness Alliance and the Wilderness Society, to permanently enjoin construction on a 28-mile section of the Burr Trail in Garfield I County. Although Garfield County was allowed to continue with its construction, con-struction, the court delayed improvements im-provements in certain other areas until certain botanical studies were conducted to the BLM's satisfaction, satisfac-tion, until the county applied to the BLM for a permit to move a portion por-tion of the road from a riparian area up onto a bench above The Gulch, and until certain archaeological sites were identified, to the BLM's satisfaction. An appeal of the District Court's decision to the Tenth Circuit Cir-cuit Court of Appeals in Denver resulted in a decision that only the BLM could determine whether National Na-tional Environmental Policy Act requirements had been met for the proposed construction on the road. The court ruled that construction be delayed on areas that adjoin or unduly degrade a Wilderness Study Area, in effect, upholding the District Court decision, but requiring the county to seek a partial dissolution of the injunction. When Garfield County sought the partial dissolution, the environmentalist group again objected, ob-jected, asking the court to delay in dissolving any part of the injunction injunc-tion until the Environmental Assessment, As-sessment, currently underway by the BLM, is completed. But the court denied the request, ruling that it was the intent of the Tenth Circuit Cir-cuit Court decision that the injunction injunc-tion on areas not bordering or unduly un-duly degrading WSA's be promptly dissolved. |
