SUMMONS Civil No. 2958 THE STATE OF UTAH TO DEFENDANTS John Does and to all other persons unknown claiming any right, title, estate or interest in, or lien upon the real property described herein. You are hereby .summoned and " required to file an Answer in writing to the Second Amended Complaint which has been filed in this action with the clerk of the above- entitled Court, and to serve upon, or mall to Thomas M. Higbee, Plaintiffs' attorney, 250 South Main. P.O. Box 726, Cedar City, Utah 84720, a copy of said Answer within twenty (20) days after service of this Summons upon you. If you fail to do so, Judgment by Default will be taken against you for the relief demanded in said Second Amended Complaint. A copy of the Second Amended Complaint has been delivered to the Clerk of the Court which may be obtained from her at any time without charge. The real property subject of this action is located in Garfield County, Utah, and is described as follows: The Northeast Quarter of the Southwest Quarter of Section 21 in Township 35 South of Range 3 East of the Salt Lake Meridian, Utah, containing 40 acres. ALSO, beginning 5.33 chains East from the Southwest corner of the Northwest Quarter of the Southwest Quarter of Section 21, Township 35 South of Range 3 East of Salt Lake Meridian and running thence East 14.69 chains, thence North 7.41 chains, thence South 71 deg 45 min West 17.03 chains thence South 33 deg 30 min East 2.55 chains to the beginning containing 7.48 acres, be the same more or less. ALSO, beginning 20 chains North and 5.33 chains East from the Southwest corner of Section ai, Township 35 South of Range 3 East of the Salt Lake Meridian and "running from thence East 23.62 chains, thence South 70 deg West 20.50 chains thence North 34 deg 30 min West 2.55 chains to the place of beginning, containing 8.30 acres, be the same more or less. EXCEPTING the following described tract: The East 113 feet of the Northeast Quarter of the Southwest Quarter of Section 21, Township 35 South, Range 3 East of the Salt Lake Meridian, containing 3.309 acres, more or less, ALL WATER and water rights are excepted from this conveyance.
