Show Garfield County REiolnUon No. 17M A RESOLUTION AMENDING THE GARFIELD COUNTY BUILDING PERMIT ORDINANCE, NO. 175-2. The Board of Commissioners of Garfield County, ordain that the Garfield County Building Permit Ordinance be amended as follows: Section 1. Any person, before building, or structurally altering any dwelling house or building of any kind, at a cost of $1,000.00 or greater, within the unincorporated areas of the County shall first obtain a permit from the County Clerk. Section 2. The party seekingsuch permit shall file an application with the County Clerk, setting for the true and correct name of applicant, the legal description and street address of the property on which the work' is to be done, a declaration of the probable value and the nature of proposed structure, or alterations-and the date the application is made. Section 3. Upon receipt of the application, the County Clerk shall Issue a tentative permit if the applicatoin is properly completed, the proposed building meets alL applicable laws, and the building plan is approved by the Utah Department of Health. The County Clerk shall place the matter on the agenda of the next County Commission meeting for final approval. Section 4. Any person, including property owner and worker, who fails to comply with the imiimnmiiiiiiiiimiiiiHitiiiiiiiuuii provisions of this ordinance shall be guilty of a misdemeanor, and shall be fined In an amount not to exceed $299.00, or by Imprisonment In the County Jail for a term not to exceed three months, or both. Each day of noncompliance Is a separate offense. Section 5. There Is hereby created the position of "Building Inspector". The Building Inspector shall have the' following powers and duties: (1) To enter any building or premise where the work on construction or altering any building Is going on, for the purpose of making Inspection at any reasonable hour. (2) To order all work stopped on the construction or alteration of buildings when such work Is being done in violation of any provisions of any ordinance relating thereto, or in violation of the subdivision or zoning ordinance. Stop orders must be in writing. Work shall not be resumed after the Issuance of a Stop Order without the written permission of the Building Inpsector. (3) To enforce the provisions of all applicable construction codes. (4) To inspect all buildings being constructed or structurally altered. (5) To review all building permit applications to determine whether proposed building sites will be reasonably safe from flooding. (6) To review subdivision ' proposals with the County Commission. (7) To review all ! building permit applications " with the County Commission, (8) -To inspect construction, ' electrical and plumbing work to determine compliance with applicable codes. Section 6. The County Commission must approve or reject a building permit applicatioa If the Commission rejects an application, it must state with particularity its reasons for doing so. If the Commission approves an application, the County Clerk must Issue the permit upon payment of an inspection fee. For residential permits, the fee is $50.00. For com-mercial permits, the fee is $50.00, plus $25.00 for each inspection hour over an Initial two hours. Section 7. The County Commissoln may reject an apple latlon for a i building permit for ' failure to comply with the provisions of this ordinance or any other State or County Law, or upon the advise' of the Building Inspector acting in the course of his duties. Section 8. No material variation from the approved plan shall be allowed unless first approved in writing by the Building Inspector. Section 9. The Uniform Building Code, 1970 Edition, is hereby adopted. Section 10. The National Electric Code, 1978 Edition, is hereby adopted. SecUon 11. The Utah Plumbing Code of 1964, as revised June. 21, 1972, is hereby adopted. Section 12. In the opinion of the Board of County Commissioners, it Is necessary to the peace, health, and welfare of the ' " ' i ' inhabitants of the unincorporated areas of Garfield County that this ordinance become effective Immediately. NOTICE OF HEARING CAUSE NO. OSM-005 THE STATE OF UTAH TO . ALL COAL OPERATORS AND PRODUCERS, AND. 1 PARTICULARLY ALL 'PERSONS INTERESTED IN COAL MINING OPERATIONS IN THE STATE OF UTAH. Under the provisions of Section 40-8, Utah Code. Annotated, 1953, as amended, and Public Law 95-87, Surface Mining Control and Reclamation Act of 1977, the Division of Oil, Gas, and Mining is hereby given authority, to make and promulgate rules and regulations for the proper administration of the Acts. Notice is hereby given that the Division of Oil, Gas, and Mining has prepared a set of rules and regulations for the purpose of controlling both surface and underground coal mining and reclamation pursuant to Public Law 95-87. A hearing will be held on Wednesday, June 27, 1979, at 9:00 a.m., in the Executive Conference Room Holiday Inn, 1859 West North Temple, Salt Lake City, Utah. On Thursday, June 28, 1979, in the Price City Municipal Building, Conference Room No. 7, Price, Utah; a time of 1:00 p.m., has been reserved for the Board to review Industry input, and a time of 7:00 p.m., has been reserved for the public to present comments on the adoption of said rules and regulations. Anyone interested in the adoption of, or the changes and revisions thereto, shall appear and be heard on the above dates.
