two- two thirds of all members elected to each of the two houses voting In favor thereof Section 1 That it is proposed to amend section 2 Article XIII constitution of the state of Utah to read Sec 2 2 All tangible property inthe inthe in inthe the the state not exempt under laws of the United States or under under under un un- der this constitution shall be taxed in proportion to its value to be ascertained as provided by law The property of the state counties cities towns school districts municipal corporations and public libraries lots with the buildings thereon used exclusively exclusively exclusively ex ex- for foi either religious worship worship worship wor wor- ship or charitable cha purposes and places of burial not held or used for private or corporate benefit shall be exempt from taxation Water Vater rights ditches canals res res- reservoirs reservoirs reservoirs power plants pumping plants transmission lines pipes and flumes owned and used by individuals or at corporations for irrigating lands within the state owned by such individuals or corporations or the individual i members thereof shall not be separately taxed as long as they shall be owned and used exclusively exclusively exclusively ively for such purposes Power plants power transmission lines and other property used for generating generating gen gen- and and delivering electrical power ewer a portion of which is used for or furnishing power for pumping pumping pumping pump pump- ing water for irrigation purposes on lands in the state of Utah may be exempted from taxation to the extent that such proper property Is used for such purposes These exemptions shall accrue to the benefit of the users of water so pumped under such regulations as the legislature may prescribe The taxes of the indigent poor may be remitted or abated at such times and in such manner as may be provided by law The legislature may provide for the exemption from taxation o 0 of f homes homesteads and personal property persons who served in any war in the military service of the United States or of the state of Utah and by the unmarried widows and minor orphans of such persons may be exempted as the legislature may CONSTITUTION OF THE STATE OF UTAH RELATING TO PROPORTION OF STATE CON TO SUPPORT MINIMUM MINIMUM MINI MINI- MUM SCHOOL PROGRAM IN PORTION OF PUBLIC SCHOOL SYSTEM Be it enacted by the Legislature Legislature Legislature Legisla Legisla- ture of State of Utah two thirds of all members elected to each of the two houses voting in favor thereof Section 1 It is proposed t to tJ amend sec 7 of Article XHI XIII of the constitution of the state of Utah so that the same shall read as follows Sec 7 The rate rate-of taxation on tangible property shall not exceed exceed ex on each dollar of valuation two two and and tenths four-tenths mills for general State purposes and such additional levy as the Legislature Legislature Legislature Legisla Legisla- ture may provide for the States State's share of the support of a portion of the public school system as defined in Article X Section 2 of this Constitution such portion consisting only of kindergarten schools common schools and high schools The State shall contribute not more than 75 of the total cost of operation and maintenance of a minimum school program in the State as such program shall from time to time be determined upon by the Legislature Not more than 75 0 75 of the States State's portion of the revenue I necessary to finance the opera opera- tion and maintenance of such minimum school program shall be raised by a State property tax levy and the remainder thereof shall be raised from other State sources The Legislature shall determine by law the method of allocation of the States State's contribution con OF THE CONSTITUTION OF THE STATE OF UTAH RELATING TO ALLOCATION 0 OF F REVENUES RECEIVED FROM TAXES ON INCOME AND ON INTANGIBLE PROPERTY Be it enacted by the Legislature Legisla Legisla- ture of the State of Utah two two- thirds of all members elected to each of the two houses voting in favor thereof Section 1 It is proposed to amend sec 3 of Article i XIII of the constitution of the state of Utah as follows Sec 3 The Legislature shall provide by law a uniform and equal rate of assessment and taxation on all tangible property property prop prop- erty in the State according to its I value in money and shall prescribe pre scribe by law such regulations as shall secure 3 a just valuation for taxation of such property so that every person and corporation corporation corporation corpora property or it may be taxed in such manner and to such extent extent extent ex ex- tent as the Legislature may pro pro- vide Provided that if intangible property be taxed as property the rate thereof shall not exceed five mills on each dollar of val val- When exempted from taxation as property the taxable income shall be tax taxed d dunder under any tax based on incomes but when taxed by the State of Utah as property the income shall not also be taxed The Legislature may provide provide provide pro pro- vide for deductions exemptions or and/or offsets offset on any tax based upon income The personal income income in in- come tax rates shall be graduated graduated graduated but the maximum rate shall not exceed six per cent of net income No excise tax rate based upon income shall exceed four per cent of net income The rate limitations herein contained for taxes based on income and for taxes on intangible property proper proper- ty shall be effective until January January January Janu
