forbidding proprietors knowingly to permit minors to smoke tobacco in their place lape of business providing penalties for the violation of the provisions provision S of this ordinance BE IT ORDAINED BY THE CITY COUNCIL bit OP PANG PANGUITCH U CITY UTAH SECTION 1 it shall be unlawful for any person firm or corpor corporation to barter bell sell i or offer for sale cigarettes or cigarette paper without first having obtained a permit from the city council of panguitch city said permit shall be in iii force mid and effect for one year from and after the date ot issuance unless sooner revoke d and shall be granted only to a person film or corporation owning or operating ope raring the place peace f from roni which such sales are ae to be made within Pang nitch nith city SECTION 2 E each ach permit shall be numbered and show the residence and place of business of the permit holder and shall not be transferable the city council sh shall all on reasonable notice and hearing revoke the permit of any person firm or corporation violating any provision of ordinance and no permit shall be issued to such person firm or corporation within a period of two years thereafter the city recorder shall keep an accurate record thereof and all to re vocations of permits and shall immediately certify all revoked permits to the state treasurer A t A SECTION 3 LICEN SIt PRE FEE NO permit shall be issued until tile the applicant shall have paid to the treasurer of city an annual license fee in the sum suit of fifty dollars SECTION 4 BOND no permit shall be issued until the applicant ta thereof shall have filed with the city recorder a bond to be approve I 1 L ed d by the city council which said I 1 bond shall be payable to the city of Pan gruitch for the benefit of all parties interested and shall be conditioned in the amount of five hundred dollars and conditioned upon the faithful observance of all the provisions of this ordinance and for the payment of all damage that may result from the unlawful sale of cigarettes or cigarette papers said bond shall bo be signed by the obligor as the principal and by a surety company authorized to do business in this state SECTION 4 furnishing TO 10 MINORS any person who shall to any minor under twell tyone ty one years of age by gift sale or otherwise any cigarettes or cigarette papers or wrappers or any paper made or prepared for the purpose of making cigarettes or any tobacco of any kind whatsoever shall be guilty of a misdemeanor SE SECTION 5 NUISANCE any person firm or corporation maintaining a place where cigarettes or cigarette papers br or tobacco are sold or kept with intent to sell in violation to the provisions of this ordinance shall be deemed guilty of keeping arid and maintaining a nuisance and the building or place so used for the sale or keeping for sale of cigarettes or cigarette papers P 1 or wrappers or tobacco in violation of the provisions of this ordinance shall be deemed a nuisance and such building or place abated as a nuisance SECTION 6 advertising ADVERTIS ENG DISPLAY it shall be a mis misdemeanor for any person firm or corporation cor I 1 po ration to write print publish or circulate in any newspaper magazine magaz ine periodical or circular written printed or published within panguitch city or any street sign placard or billboard or on any other place of display any advertisement of cig I 1 arestes or cigarette papers cigars Cli ewing tobacco ol 01 a s smoking tobacco or any ally disguise or substitute of either of these except that a 1 I dealer lie in tobacco and cigars may have havea a sign on oil tile the front fl olit of his place of business stating that lie he is dealing in such articles and excepting capt I 1 aig further that cigars chewing tobacco and smoking stil oking tobacco may inay be advertised in III I 1 any ally lie newspaper ws published within the city of panguitch provided however that nothing herein shall be so construed as to permit advertising ing of cigarettes or cigarette paper in in any manner SECTION 7 MINORS IN PLACE Z or OF BUSINESS it shall be a misdemeanor for the proprietor prop rictor of any place of business to knowingly permit minors under twenty one years of age to frequent such place of business while in the act of using tobacco in any form the term place of business as here used elised shall apply to tonny any and all such places as shops stores factories public garages offices theatres theartres the atres recreation and dance halls balls pool halls pool rooms cafes cafek cafeterias cabarets restaurants hotels lodging houses and waiting rooms within panguitch city SECTION 8 PUBLIC PLACES SMOKING ROOMS it shall be a misdemeanor for any person to smoke cigars cigarettes or tobacco in any form in any public place within pan duitch city except in extra rooms compartments or coaches specially provided for smoking purposes the term public places as here used shall be construed to mean the dining rooms in hotels restaurants cafes and cafeterias theatres theartres the atres motor and other passenger coaches employed as a cornmon common carrier except waiting rooms county and city building except that the owner or proprietor of any hotel dining room restaurant cafe or cafeteria may designate the same as a public smoking room by a conspicuous sign at or near the entrance provided further that in any county or city building any public officer who has a private office may designate such private office as a place where smoking may be permitted and so longas such private office is is so designated smoking therein shall not be considered a violation of this ordinance SECTION 9 PENALTY any person convicted of violating any of the provisions ot this ordinance shall be deemed guilty of a misdemeanor and punished by afine a fine not exceeding two hundred nine ty nine dollars or by imprisonment in the city jail not exceeding six months or by both such fine and imprisonment this
