Show NOTICE OF TRUSTEE'S SALE. Whereas, Charles August Allen and Elon L, Alien, his wife, of Utah Countv, Utah, executed, exe-cuted, acknowledged, and delivered to James H. Bacon, trustee, their certain trust deed, bearing date the first day of December. A. D. 1890, which said trust deed was recorded in the recorder's office of Utah County, Utah, in Book "8" of Trust Deeds, on paires 228, 229, 230 and 231 of the records of said oihce, and given to secure se-cure tho pavment of Twenty-two Hundred Dollars, as evidenced by a certain first mortgage bond or a'!te, bearing even date wjth said trust deed, and payable on the first day of December, A. D. 1895, with interest thereon at the rate of eight per cent, ner annum, an-num, payable semi-annually, as evidenced by ten interest counona to said first mortg- ge londorno'e attached, and which said trust deed was given upon the following described premises, situated in the County of Utah and Territory of Utah.to-witijcommencingtwenty-(20; chains north ol the southwest corner of nec-tion nec-tion twenty-nine (2s)) township eight (8) , south of range two (2), east ralt Lake meridian; thence east twenty (2o) chains; thence north ten (10) chains: thence west twenty 20 1 chains; thence south ton 1 10 chains to the place of beginning. be-ginning. Also one-fourth of the water in the Pond i'own Slough, togetherwith any and all water rights owned by the said Charles August Allen and Elon L. Allen, or either of them, or belonging to or with or used upon said premises, or any part thereof. And Whereas, it is provided in said trust deed among other things that incase default be made in the payment of eitner of said notes, indebtedness, or moneys secured bv said trust deed, or of the taxes or aesesssments on said premises or any part thereof, or in case of the breach of any of the covenants in said trust deed contained to be kept and performed by the said Charles August Alien and Elon L, Allen, then to sell and dispose of said premises, prem-ises, or any part thereof, and said water rights, together with all the right, title, benefit bene-fit and equity of redemption of the said Charles August Allen and Elon L. .alien, their heirs and assigns therein forever, either in mass or in separate parcels, as the holder or holders of said bond and notes may prefer, at public auction, at the front door of t.ie Court House in the County of Utah and Territory of Utah, or on said premises, as may be specified in the notice of such sale for the highest and best price the same will bring in cash, after first giving tnirty days previous notice ot such sale by publication in any newspaper at that time published in the said County of Utab,and tomako, execute, acknowledge and deliver to the purchaser or purchasers at said sale good and sufficient deed or deeds of conveyance for the premises sold. .'And Whereas, itisaiso provided in said trust deed, among other things, that in case default be made in the pajmentof any or either of the indebtedness or moneys secured thereby -whether of principal or intertbt, or ( f the breach of any of the covenants in said trust deed contained, to be kept and perf ormed bv the said Charles August Allen and Elon L. Allen, then any and all of the moneys thereby there-by secured shall upon such default, at the option of the holder of said indebtedness, become be-come immediately due and payable, anything in said trust deed or in said bond or notes contained to the contrary, notwithstanding. And Whereas, Charles August Allen and Elon L. Allen have both and each made default in the payment of the interest on said indebtedness, dueon the first day of December, A D. 1893; on the first day of June, A. D, 1891; and on the first day of December, A. 1). 1894; nd Whereas, tne legal holder of said indebtedness indebted-ness has declared the whole ol said indebtedness indebted-ness to be now immediately due and payable and requested said trustee to advertise and sell said promises and water rights, pursuant to the power and authority in him vested in and by said trust deed ; and whereas, itisaiso provld3d in said trust deed that in case of the death, absence from said Utah County, inability or refusal to act ot the said James H. Bacon, that then Harvey M. Bacou shall be and is by snid trust deed appointed snd made succpssor in trust to said James H. Bcon, with like powers pnd authority, author-ity, and said premises thereuprn becomes vested in said suocessor in trust, for the uses and purposes in said trust deed mentioned; and Whereas, sad James H. Bacon is absent from said Utah County, unable to and refuses to act in the premises. Now i heretore public notice ia hereby given that I, Harvey M. Bacon, successor in trust as aforesaid, will on Thursday, the 21st day of February, A. D. 1895, at ten o'cloc a m. of said day at the north frontdoor of the County Coun-ty Court House in the City of Provo in Utah County, Utah, sell at public auction to the highest and best bidder tor cash, said premises prem-ises and water rights hereinbefore described, together with all the right, title, benefit and equity of redemption of the said Charles August Allen and hlon L. Allen, their heirs and assigns therein forever for the purpose of paving said indebtedness and interest thereon, there-on, and the costs, attorney's fees and expenses of executing this trust, and will matte, execute, exe-cute, acknowledge and deliver to the purchaser pur-chaser cor purchasers at said sale, good and sufficient deed or deeds of conveyance for the premises sold. .
