Show DISTRICT COURT. Magnus Erickson is Sentenced Sen-tenced to Three Months. LOOKS LIKE CONSPIRACY Was Laid Against Him and Efforts Will Be Made to Procure a Pardon John W, Beaaley Wins His Case Anna Marts Again in Court. Magnus Erickson, the Ifiphraim city marshal convicted early in the fall of adultery with Mrs, Harriet Hansen, appeared before Judge Smith yesterday yester-day afternoon for sentence. Mr. Ericfeson's attorneys pleaded for a light sentence stating that it was more than evident now that the theory of the defense de-fense at the time of trial was right from the fact that since the conviction of Mr. Erickson, Mrs. Haneen, Erick-eon's Erick-eon's partner in crime if crime was committee, has gone hack to .live with her husband. The theory of the defense de-fense was that a conspiracy was entered en-tered into by enemies of the city marshal to ruin hia character and him financially, socially and in every way. Prosecuting Attorney Thurman, on being asked by the judge for a statement, state-ment, remarked that at the time of the trial he did not believe that the theory of the defense was correct. He was not prepared to say that he believes it true now, but it was a fact that at the trial, as counsel for cUfenBa had stated, Mr. Hansen, his brother, and others of the prosecuting witnesses, were very bitter at Mr. Erickson and apparently 'tt Mrs. Hanson also; it is a fact now that Mrs. Hanson has gone back to liv.e with her husbacd and all is peace and harmony in the family ,and he has been entreated by Mr. H&nson not to prosecute his wife for adultery under the indictment that is out against her To say the least this is a rather peculiar state of affairs Judge Smith expressed a willingness to sin a statement of probable cause should the case be appealed. Erickson was sentenced to thres months in the penitentiary and a stay of execution was had till this morning to prepare a statement on appeal. This morning, however. Mr, Erickson had concluded that the expense of an appeal was more than he could bear under hia present financial circumstances circum-stances and he went to the penitentiary. peniten-tiary. JOHN BEA8LEY VICTORIOUS. Ten of the jury in the Beasley vp. Sparks et al case agreed to a verdict in favor of the plaintiff for $750.87 and $74.50 interest. The other -two jurors, it is understood, agreed that the bricks levied upon were the property of John Y. Beasley, but did not agree as to the value of the properly. MARKS VS. 8DXL1VAN ET AL. The case on ' trial today is an old damage case that has once been tried, in April, 1892, resulting in a verdict of $3000.00 for the plaintiff. The case was taken up to the supreme court and sent back for a second trial. A judgment by default was entered during this term of court in favor of defendants. John M. Zane the other dy succeeded in getting that judgment judg-ment set aside. Now he is out of the case and Mr. Schroeder represents Mrs. Marks. J. W. N. Whitecoiton appears for the defendants. The Euit is brought not only against John L, 8ullivan, sheriff, but also against D. S. Dana, justice of the peace, and Belle Tompkins, Tomp-kins, now Mrs. II. G. Wilson. The incidents are that in the year 1S87, Sheriff Sullivan went Mr3. Marks' store to collect a judgment and costs in a suit that had been brought against Mrs. Marks by Belle Tompkins. Mrs. Marks refused to pay and resisted the officer in the discharge of his duty, He went to the justice and got a warrant for her arrest. When she was arrested she became hysterical and considerable force had to be used to take her to court. She8ues for $5,000.00 damages for ill-treatment . and for illegal imprisonment. im-prisonment. When the prosecution rested today at noon the judge ordered the case dismissed dis-missed as against Justice Dana.
