The people of the territory of Utah send greeting: To James Weber, defendant. You are hereby required to appear in an action ac-tion brought against you by the abov" named plaintiff, in the District court of the First ,1 u-dicial u-dicial i-istrict of the territory of tah, and to answer the complaint filed therein, within ten days (exclusive of the day of service) after t' e service on you of this summons if served within this county: or if served out of this county, but in th's district, wilnin twenty days; otherwise within forty days or judg-meir judg-meir by default will be taken against you according ac-cording to piayer of this complaint. The said action is brought to ob'ain a decree de-cree of this court for the foreclosure of a certain cer-tain mori gage described i the complaintan ' executed by.the said defendant on December 22, 1891, at Scoiield. Emerv county, Utah, whereby defendant promised to pa-' on or before be-fore the 1st day of April, 1892. the sum of $288.00 with iuterest at 10 per cent per annum after maturity. That on April 1st the sum of $i00 00 was paid and the further sum ol" $i't 00 was paid on the 5th day of Decemb'T. 1892, and thjre now remains the sum due of $157.00 with interest at 10 per cent, per annum from December 5, 1892. Wherefore plaintiff prays judgment for the sum of $157.00 togeihrr wit" interest thereon at the ra'e of 10 per cent, per annum from the first day of April 1892, and the further sum ol $2o.00 attorney fees and for costs of suit That the usual decree may be made foi the ssle of sMd premises by the sheriff sher-iff of Car joncounty. Utah territory, according accord-ing lo law arwitne practice ot this court; thai the proceed! of said sale may be applied in payment of liie amount duo to plaintiff, and that said plaintiff may have judgment and execution ex-ecution agaiist said defendant for any deficiency defi-ciency which may remain after applying all the proceeds of said sale of said premises properly applicable to the satisfaction of said judgment.
