Plaintiff alleges that the deteudant herein executed his certain promissorv note, umcu November 18th, 1893, payable six months af ti r date at Eureka, Utah, wita 2 per cent per month interest. That the same bus not been paid and that the defendant herein is the legal owner and holder thereof. That the said note was secured upon pronertv more fully de-s de-s ribed in tbe complaint hereto: lhat the usual decree i.iay be made for the sale of said property and the premises sold by the sheriff of Juab county, Uiaa, according to law and the practice of this court, and that all persons claiming under him subsequent to the execution of said mortgage, either as purchasers or incumbrancers be barred and foreclosed of all right, equity and redemption and that plaintiff may have judgment and execution for any balance which may remain after applying the proceeda of tbe sale rpon said premises.
