The zacc being tried in the First District courtthis afternoon is the suit broughc against Artemus Holman of Pleasant Grove by the city of Pleasant Grove to collect S1S.50 tax assessed against him for his proportion of the cost of distributing the waters of the irrigation system of the city. Mr. Holman's land that is irrigated lies I outside the coporate limits of the city of PleaBant Grove. As a matter of law J udge Smith has ruled in three separate casea that the assessment of water tax against land lying outside the corporate corpor-ate limits of a city but irrigated with the city's water is legal. The only question therefore that was left for the jury to determine, was whether or no the tax was a just or equal one, equal with the tax' assessed against other lands on the stream.
