A night session of the First District court wa3 held yesterday in order to get the hearing of the Jerry M.Richard-Bon M.Richard-Bon rape case begun. Hearing of the Tuttle vs. Marks cape was not concluded, con-cluded, but is on trial this afternoon. Judge Powers defends IlicnardBon. Sam. A. King assists Judge Jndd with the prosecution. The case is being tried behind closed doors. Richardson Richard-son is an expert piano player and was up at Heber City last fall teaching music. He will be remembered as the young man, a Mr. Cramer tcok a shot at in Salt Lake city some months ago because of some-alleged mistreatment of Cramers's daughter by Richardson. Rumors are afloat also concerning him to the effect that he has employed himself him-self frequently as "harmony slinger" in houses of ill-fame for a livelihood. In examining the jurors, evidently evi-dently because of these rumors, Judge Powers was very particular to ask them if they would as readily give the defendant in this case the benefit of any doubt that may ariee in their minds as to his guilt after hearing the evidence, as they would a defendant against whose reputation nothing improper other then the charge for which he is being tried would appear. The defense exhausted all of their peremptory challenges, the prosecution did not 'challenge one juror peremptorily. Richardson is a married man. His wife, a tall, dark-eyed beauty, is a witness wit-ness for the defense who answers the questions put by the prosecution very snappishly, but who otherwise seems not to be worried at all because of the predicament her husband is in. He is accused of committing the crime of rape upon the person per-son of Lucy J. Seamon, a 16 year-old girl of Heber city, whose parents are dead and who lives with her uncle. It is alleged in the indictn ent that be used force ar.d practiced fraud in order to accomplish his hellish purpose, fraud by inducing her to drink blackberry brandy which was drugged. Miss Seamon Sea-mon is a tall and stately girl, with golden hair and pleasant features, very well matured for her age. On the witness wit-ness stand tears welled to her eyes and she told of her trouble and ruin with much evidence of deep mortification. She testified that she had taken music lessons from the defendant and the two had become somewhat tauiliar. On Ociober 3rd last he asked her to ride with him over to Park City, saying he wanted to se his wife who was over there. She consented, and on the return re-turn trip he stopped at Red Pine creek to feed his horse. He induced her to drink some liquor which Btupefied her, and w hile she was In that condition he accomplished his design. Dr. Green, a lady practicing physician, physi-cian, testified that she was called upon to examine Miss Seamon and found her hips and back bruised and torn, and other evidences of great and undue force of an improper nature having been used, so much so that the girl could not walk erect for some time, and is now suffering with prolapsus. Alfred McCune testified to having seen the couple upon the ground, Richardson Rich-ardson apparently having just completed com-pleted his crime. The defense placed upon the stand Mrs, Richardson, Attorney Hayes and Sheriff Fraughton. Mrs. Richardson te6ti6ed that sue had taken two drinks before supper and one before breakfast break-fast next morning of the blackberry brandy her husband had. The bottle when her husband gave it to her was about one-third full and it was alleged to be thfreame bottle out of which Miss Seamon drank. The liquor had no effect ef-fect upon her other than to slightly ex-hilerate ex-hilerate her;it was not drugged. She did not know until her husband was arrested ar-rested the following Monday that he had Miss Seaman riding with him to Park City. After the arrest she heard Miss Seaman say that Jerry failed in his attempt to rape her. Hayes and Fraughton corroborated her as to admissions ad-missions made by Miss Seaman. The defense is that the girl gave her consent con-sent to whatever transpired and hence rape was not committed. It has not developed yet as to what will be done should the Jury incline to this view. Undoubtedly the man was guilty of something ; if not rape, attempted rape, adultery or an attempt to commit adultery.
