Show IN THE DISTRICT COURT OF THE FIRST Judicial District of the territory of Utah Utah county. Mary Malcolm, plaintiff va Archibald Malcolm, defendant. The people of the territory of Utah send greeting- to Archibald Malcolm, defendant. Tou are hereby required to appear in an action brought against you by tho above-named above-named plaintiff, in the District Court of the First Judicial District of the territory of Utah, and to answer the complaint filed therein, within ten days (exclusive of the day of serr vice) after the service on you of this summons if served within this county: or, if served out of this county, but in this District, within twenty days; otherwise within forty days or judgment l y default will be taken against you, according to the prayer of said complaint. The said action is brought to obtain a decree of this Court, dissolving the bonds of matrimony matri-mony heretofore and now existing between the plaintiff and you, said def 3ndant, on tho grounds that you on or about the 31st day of November, 18bG, disregarding the solemnity of your marriage vow, wilfully and without cause deserted and abandoned plaintiff, and ever since have and still continue so to wilfully and without cause desert and abandon plaintiff plain-tiff and to live separate from her, without any suflicient cause or any reason, and against hor will and without her consent; that for more than one year last past, to wit: from the 31st day of November, 1866, to the date hereof have wilfully neglected to provide lor plaintiff the common necessaries of life, having the ability so to do, and compelled plaintiff to live on the charity of her friends; that the care and cui-tory cui-tory of said children (mentioned In said complaint! com-plaint! be awarded to plaintiff; that you be required to pay a reasonable sum into Court to defray the expenses of this action, and for counsel fees and for costs. (For fuller particulars reference 1 hereby made to the complaint on file in this action.) And you are hereby notified that if you fail to uppear and answer the said complaint as above required, the said plaintiff will apply to the Court for tho relief demanded therein. Witness the Hon.
