Cheek January 1, 1939 – February 27, 2020 Carl W. Cheek Sr. was born on New Year’s Day 1939 in Blossberg, Alabama. Raised in Maryland and always a hard worker, he excelled in school and sports. He was the first in his family to ever attend college, earning a football scholarship (QB) at William and Mary. He was inducted into the William and Mary Athletic Hall of Fame in 1988. In appreciation to his alma mater, Carl endowed three scholarships at William and Mary and was always one of its strongest supporters. After serving his country in the U.S. Army Special Forces, 82nd Airborne and earning the rank of Major in the U.S. Army Reserves, Carl began his successful business career, founding Specialty industries in 1972. He built the company from the Carl W. Cheek ground up, growing it into one of the largest employers in Central Pennsylvania. He proudly brought his sons, Carl W. Cheek, Jr., and Frederick Cheek into Specialty. Carl married the love of his life, Sylvia, in 1994. They moved to Florida in 1999. Carl was happiest at his home in Longboat Key, as well as their home in Park City. He cherished his lifelong friends from Sigma Nu and never forgot where he came from. Carl passed quietly on Feb. 27, 2020, with his wife Sylvia by his side. He will be interred with his parents, Hubert Cheek and Grace Evelyn Black Cheek. He is survived by his wife, Sylvia, children Carl W. (“CW”) Cheek, Jr., Frederick Cheek (Debbie) Anne Cheek grandchildren, Ellie and Haden Cheek, and niece Mary Rachel Kostreva. A celebration of life will be held March 6, 2020, at 4 p.m. at Jone Durante Park on Longboat Key. Successful candidates will exhibit expertise in the responsibilities below as well as strong problem-solving, project-management and process-improvement skills are preferred. Excellent written and oral communication skills and an open and honest communication style that promotes teamwork are desired. Responsibilities Include (but are not limited to): • Preparation of the P&L and balance sheet for month-end – create all journal entries • Assists in the revenue budget process – complete preparation of the expense budget • Monthly/annual forecasting • Collections • Daily DCRs • A/R and A/P • Assist the classified advertising team with questions, etc. • Prepare classified ads for local walk-ins • Assist customers with billing issues • Prepare billing adjustments • Trained in circulation accounting for vacation fill-in • Some office management Law firms file class-action suit against Vail Resorts Plaintiff claims net performance of 401(k) was poor TAYLOR SIENKIEWICZ Summit Daily FRISCO, Colo. — A class-action lawsuit filed against Vail Resorts accuses the company of failing to effectively monitor 401(k) retirement plan investments. The suit was filed Feb. 24 by Baird Quinn, Greg Coleman Law, Crueger Dickinson and Jordan Lewis, and it alleges that Vail Resorts is in breach of its fiduciary duties defined under the Employee Retirement Income Security Act. The plaintiff, Debra Kurtz, who is a representative of the class of participants, claims she and all participants in the Vail Resorts 401(k) retirement plan suffered financial harm. The lawsuit focuses what it calls high administrative fees and poor net performance of the plan, which the plaintiff claims violate the company’s fiduciary duty. “These investment options and unreasonable fees cannot be justified,” the lawsuit reads. “Their presence confirms more than simply sloppy business practice; their presence is the result of a breach of the fiduciary duties owed by Vail to plan participants and beneficiaries.” The lawsuit outlines the scope of the company’s retirement plan, which had 8,276 participants at the end of 2018. The document uses a benchmarking analysis to determine that the expenses incurred by participants of the Vail Resorts 401(k) retirement plan are nearly double those of the mean among 19 comparator plans. The lawsuit claims Vail Resorts is liable to return the losses resulting from any breaches of fiduciary duty to retirement plan participants and give to plan participants Qualifications: • Demonstrate excellent interpersonal and communication skills as well as strong work ethic and positive and proactive attitude • Perform efficiently with a strong attention to accuracy • Effectively utilize analytical and problem-solving skills • Ability to organize, prioritize, maintain time management, manage stress level and multitask while maintaining flexibility • Excellent computer skills including the ability to operate computerized accounting programs and proficiency in Microsoft Excel and Word • 1 – 3 years of general accounting experience to include creating journal entries and balance sheet reconciliations • Compensation depends on experience the profits made by Vail Resorts through the use of 401(k) plan assets or resulting from breaches. Lewis said an actual trial might not be held for two to three years and that in the first stage of the court process, the only record is the complaint. There are then potentially months in court as it is decided whether the case qualifies as a class-action lawsuit. Ultimately, a judge determines if the case is certified as class action. If the judge decides it isn’t, it becomes an individual case. If it does become a class action, there will be more discovery and a second round of motions before a trial ensues. Lewis added that because this is an Employee Retirement Income Security Act case, there are certain rules that the statute imposes, one of which is that there is no jury.
