Show A4 The Emery County Review, Tuesday, October 14, 2008 Ferron City holds first council meeting since mayor’s resignation Josie Luke In the first city council meeting since the resignation of their mayor, Ferron City, under the leadership of Mayor Pro Tempore Trent Jackson, conducted what may be one of the shortest city council meetings on recent record. Lasting less than an hour, the agenda items in the meeting were worked through with swift execution. With no items set for planning commission recommendations, and no one appearing for board of equalization consideration, the council quickly moved on to a request for a connection to the Molen water line. Sidney Larsen approached the council for permission to connect property he wished to sell into the line, but because the request in fact needed to be voted on by those who owned the 34 Molen connections, the council referred him back to the water users. Jackson explained that before ap- proaching the city, Larsen needed a majority vote from the water users. If the users support additional connections, the Molen users can then approach the council to change the contract with the city. The council also reviewed a request from Nancy Johnson to purchase city property between her property line and the city’s required right-of-way. The council discussed the proper policy for the request and found the next step in the process would be to hold a public hearing on the proposal. They scheduled the hearing for Oct. 23. Also on tap for the Oct. 23 meeting are a review of the draft anti-fraud policy and business license revisions. The two discussions were on the agenda, but in order for the council to become more familiar with the policies, the items were postponed. The council will also appoint a new mayor at the later meeting. Clawson Town Council praises citizens and sponsors for Harvest Celebration success Josie Luke The Clawson Town Council expressed their appreciation to citizens and sponsors of their Harvest Celebration at the town meeting held Oct. 9. Clawson held the cel- Public Notice ebration on Sept. 20, and despite a rainstorm citizens enjoyed the event. At the town meeting Mayor Carey Bloomer reported they had actually made money with the bake sale and auction held during the celebration. During council reports, Councilmember Gerry Hatch reported that at a recent special service district meeting, he had jokingly encouraged the other communities in the county to follow Clawson’s lead on spending. Though Hatch made the remark in jest, the numbers he gave revealed a huge funding discrepancy for Special Service District funding between Clawson and the other surrounding communities. Despite Emery receiving over $200,000 next year, Clawson will only receive $17,000. Even when the numbers are calculated to consider population, the gap is still shocking. Using 2000 census data, Clawson’s funding would be $111.11 per capita, with Emery receiving $650.20 per capita and Ferron receiving $229.36The council also held the first public hearing to receive input on recommendations for projects to submit for Community Development Block Grant funding. Council members have been considering adding an addition to the town hall building to include a community center for town gatherings, but because no one attended for the public meeting, they elected to take it up at the next city council meeting. COURT REPORTER Appearing Oct. 7 in Seventh District Court before Judge George M Harmond were: Zachary Adam Dewaal. Charged with Attempted Illegal Possession or Use of a Controlled Substance, Dewaal pled guilty to the Class A Misdemeanor on Aug. 5. In sentencing proceedings Dewaal was sentenced to a suspended one year term in jail, fined $700, ordered to serve 100 hours of community service and placed on probation for 24 months. He may be subject to random drug screenings and was ordered to not consume alcohol of drugs and to be gainfully employed or in school full time. Julian Lyle Bowman. Bowman faces a 2nd Degree Felony charge of Retaliation Against a Witness or Victim and two Class B Misdemeanor charges of Disorderly Conduct. In Bowman’s initial appearance the defendant was advised of the charges and penalties and Bowman requested a preliminary hearing. A preliminary hearing is scheduled for Oct. 15. Chantel Brown. Brown pled guilt in September of 2007 to a Class A Misdemeanor charge of Attempted Unemployment Compensation – False Statement. In a review hearing the court was advised that Brown has been making her restitution payment. A review hearing is scheduled for October of 2009. Cody Butler. Butler faces a Class A Misdemeanor charge of Criminal Mischief – Intentional Damage; and a Class B Misdemeanor charge of Unlawful Purchase by Interdicted Person. He pled guilty to both charges on Oct. 7. Butler waived time for sentencing and the court ordered him to serve one year in the Utah State Prison. He was also ordered to pay $300 in restitution. Dustin Steven Byerly. Byerly pled guilty in May of 2005 to a Class A Misdemeanor charges of Attempted Domestic Violence in the Presence of a Child and Attempted Aggravated Assault. In post sentencing proceedings Byerly’s probation was revoked and reinstated for 12 months. He was ordered to provide proof that he had completed domestic violence outpatient treatment and had attended the aftercare program. Kayla Carter. Carter pled guilty in December of 2007 to Class A Misdemeanor charges of Possession of a Controlled Substance and Use or Possession of Drug Paraphernalia. In an incourt note the $500 bail that was posted is to be refunded to the defendant and an order to show cause hearing is scheduled for Nov. 5. Mick Chaffin. Chaffin pled guilty in January to an amended Class A Misdemeanor charge of Theft by Receiving Stolen Property. In an arraignment notice the court found Chaffin indigent and appointed David M. Allred to represent him. An Order to Show Cause Hearing is scheduled for Nov. 5. Joshua Christman. Christman faces a Third De- gree Felony charge of Aggravated Assault. Christman pled not guilty. A pretrial conference is scheduled for Nov. 18. Alan Gardner. Gardner faces a First Degree Felony charge of Aggravated Burglary and a Class A Misdemeanor charge of Simple Assault. In his initial appearance Gardner waived a preliminary hearing and the court ordered the $10,000 bon to be continued on the case. A preliminary hearing is scheduled for Nov. 24. Maurice Joseph Gelpi. Gelpi faces a Third Degree Felony charge of Failure to Stop/Respond at Command of Police; Class B Misdemeanor charges of Unlawful Purchase by Interdicted Person and Operating Vehicle without Insurance; and Class C Misdemeanor charges of Speeding, Right of Way – Stop or Yield Sign, and Driving on a Denied License. In his initial appearance Gelpi requested a preliminary hearing. The court appointed David M. Allred to represent him. A preliminary hearing is scheduled for Oct. 21. Fred Thomas Lujan. Lujan faces two First Degree Felony charges of Child Kidnapping and two First Degree Felony charges of Aggravated Sex Abuse of a Child. He also faces two First Degree Felony charges of Distribute/Offer/Arrange to Distribute a Controlled Substance and a Class A Misdemeanor charge of Use or Possession of Drug Paraphernalia. A hearing on reports is scheduled for Nov. 5. Juan Carlos Moreno Martinez. Martinez is a fugitive of justice from another state. Martinez waived extradition and was picked up by the demanding state. Corey Shane Price. Price faces a Class A Misdemeanor charge of Reckless Endangerment and a Class B Misdemeanor charge of Driving Under the Influence of Alcohol or Drugs. He pled guilty to both charges and waived time for sentencing. He was sentenced to a suspended one year prison sentence, ordered to pay a $750 fine and ordered to provide two days of community service in lieu of two days in jail and placed on probation for 24 months. Jeremiah M. Ralphs. Ralphs pled guilty in November 2007 to an amended Third Degree Felony charge of Burglary and a Class A Misdemeanor charge of Attempted Burglary. In a review hearing the court was informed that the defendant was ordered to take a urinary analysis, which he passed. A review hearing is scheduled for Dec. 2. Michael David Sadler. Sadler faces an amended Third Degree Felony charge of Attempted Purchase/ Possession of a Dangerous Weapon. He pled guilty to the charge. A pre-sentence investigation was ordered and the defendant was released on his own recognizance. Sentencing is scheduled for Dec. 16. Joanna Hernandez Sanders. Sanders faces a Class A Misdemeanor charge of Bur- glary of a Vehicle, and Class B Misdemeanor charges of Theft and Possession of a Controlled Substance without a Prescription. The court made a motion for a continuance of the initial appearance and the motion was granted. The defendant was in the hospital due to a wreck and was unable to appear. The initial appearance is scheduled for Oct. 21. Randy Lee Saylor. Saylor is a fugitive from justice from another state and he signed a waiver of extradition in the court. Julie Ward. Ward faces a First Degree Felony charge of Aggravated Burglary and a Class A Misdemeanor charge of Simple Assault. In her initial appearance Ward requested a preliminary hearing. A preliminary hearing is scheduled for Nov. 24. Kim H. Ward. Ward faces a First Degree Felony charge of Aggravated Burglary, a Class A Misdemeanor charge of Simple Assault, a Class B Misdemeanor charge of Driving Under the Influence of Alcohol or Drugs, and a Class C Misdemeanor charge of Drinking Alcohol in Vehicle – Driver or Passenger. Ward requested a preliminary hearing. The court appointed David M. Allred to represent him. A preliminary hearing is scheduled for Oct. 15. Tito Homer Whiterock. Whiterock pled guilty in December 2007 to a Class A Misdemeanor charge of Criminal Mischief and a Class C Misdemeanor charge of Intoxication. An order to show cause hearing is scheduled for Nov. 5. Deeanna Lynn Wilson. Wilson faces an amended Third Degree Felony charge of Theft. She pled guilty to the charge in July. A restitution hearing is scheduled for Dec. 9. Roy Young. Young pled guilty in June to Second Degree Felony charges of Burglary and Theft by Receiving Stolen Property, a Third Degree Felony charge of Failure to Stop/Respond at Command of Police and Class A Misdemeanor charges of Theft and False Personal Information to Police with the Intent of Avoiding Custody. In a restitution hearing the defendant’s attorney did not oppose to the amount of $3,967 to be paid in restitution. Gary Lynn Adamson. Adamson faces a Third Degree Felony charge of Driving Under the Influence of Alcohol or Drugs and Class C Misdemeanor charges of Driving on a Denied License, Open Container/Drinking Alcohol in a Vehicle, and Improper Usage of Lanes. Disposition is scheduled for Dec. 2. Fred Ortiz. Ortiz faces a Third Degree Felony charge of Driving Under the Influence of Alcohol or Drugs, a Class B Misdemeanor charge of Operating Vehicle with Alcohol in Body, and Class C Misdemeanor charges of Operating Vehicle without a License or Registration and Tail Light Violation. Ortiz waived a preliminary hearing. Sentencing is scheduled for Nov. 5. |
