Show The Garfield County Insider Page 4 December 31, 2008 LEGAL NOTICES Notice of Intended Disposition Notice is here given in accordance with the Native American Graves Protection and Repatriation Act (NAGPRA), 43 CFR 10.6 (c), of the intent to transfer custody of Native American human remains and funerary objects in the control of the Bureau of Land Management (BLM), Grand Staircase-Escalante National Monument (GSENM), Utah. A detailed assessment of the human remains and funerary objects was made by BLM officials in consultation with representatives of the Hopi Tribe, the Confederated Tribes of the Goshute Reservation, the Moapa Paiute, the Kaibab Band of Southern Paiute, the Paiute Tribes of Utah, the Northern Ute Tribe, the Southern Ute Tribe, the Navajo Nation, and the Navajo Utah Commission. In April, 2008, human remains and funerary objects were removed from 42Ga6259,Garfield County, Utah. These remains were recovered in conjunction with an FBI investigation. No known individuals were identified. The funerary objects include metal artifacts. An analysis of the human remains and funerary objects indicates that this individual dates to the second half of the 19th century, probably the 1860s or 1870s. Officials of the BLM have determined that, pursuant to 43 CFR 10.2 (d) (1), the human remains described above represent the physical remains of one individual of Native American ancestry. Officials of the BLM have also determined that, pursuant to 43 CFR 10.2 (d) (2), the funerary items noted above were removed from the above burial site of a Native American individual. Lastly, officials of the BLM have determined that, pursuant to 43 CFR 10.6 (a) , the human remains and funerary objects were removed from lands that are recognized as the aboriginal land of the Kaibab Paiute. Representatives of any other Indian tribe that wishes to claim ownership or control of the human remains and funerary objects should contact Matthew Zweifel, Grand Staircase-Escalante National Monument, at (435) 644-4326, before January 30, 2008. Disposition of the human remains and funerary objects to the Kaibab Paiute may proceed after that date if no additional claimants come forward. The BLM, GSENM, is responsible for notifying Hopi Tribe, the Confederated Tribes of the Goshute Reservation, the Moapa Paiute, the Kaibab Band of Southern Paiute, the Paiute Tribes of Utah, the Northern Ute Tribe, the Southern Ute Tribe, the Navajo Nation, and the Navajo Utah Commission that this notice has been published. The proposed action for this project includes the following: 1. Obtain right-of-way 2. Replace Calf Creek Bridge 3. Stabilize roadway at three locations where embankment or barrier is failing 4. Provide slow-vehicle turnouts at six locations 5. Improve two intersections: Hole-n-the-Rock Road; Calf Creek Recreation Area 6. Widen roadway at one narrow curve (MP 71) 7. Improve signing for bicycles, animal presence, and roadside hazards The public is advised a draft environmental assessment (EA) has been prepared for this project; this EA defines the scope of the project, alternatives, potential for environmental impact, and mitigation measures that might relieve potential impacts. FHWA has determined that the monument is a Section 4(f) resource. The proposed project would result in approximately 350 acres of federal land transfer for highway right-of-way within the monument. Based on the impacts and measures to minimize harm, UDOT recommends that pursuant to Section 6009 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) the effects of the proposed project on the monument meet the impacts criteria and requirements specified in SAFETEA-LU for a de minimis impact finding. For parks, a de minimis impact is one that will not adversely affect the features, attributes, or activities qualifying the property for protection under Section 4(f). In accordance with Section 6009 of SAFETA-LU and 23 CFR 774.5, FHWA and UDOT are providing this notice to advise all interested persons or groups of their intent to issue a Section 4(f) de minimis impact finding for the monument. Comments on the draft EA and Section 4(f) de minimis impact finding will be accepted until February 2, 2009 and should be submitted to SR-12, Boulder to Escalante, c/o H.W. Lochner, 310 East 4500 South, Suite 600, Salt Lake City, Utah 84107. Comments may also be submitted via email to sr-12@hwlochner.com. The public is further advised that an official public hearing to discuss the proposed project will be held only if requested. UPAXLP Advertise in the Insider Call 676-2621 Ads start at just $5 / week! State Nursery to Close The Lone Peak Nursery will cease operations on June 30, 2009 at the end of the fiscal year. Funding for the 32 year old state nursery program was cut in the recent special session of the legislature forcing the closure of the facility and premature sale of the remaining seedlings. Nursery Manager, Brandon Long says that agencies with planting projects starting this spring should plan to submit orders as early as January 5, 2009. The nursery staff plans to fast-track the ordering process enabling all stock to be picked up by May 28th. Seedlings will be priced at $1.29 each with a 100 plant minimum. Details on plant size and species are available on the Division of Forestry website at: http://seedlings.utah. gov. The 35-acre Draper facility has produced the types and quantities of plants not available in the public sector. The sole purpose of the Lone Peak Nursery has been to grow and sell seedlings to agencies and landowners for restoration and conservation initiatives. NOTICE OF MEETING SCHEDULE The Boulder Town Council will meet on the first Thursday of each month in 2009, except that the January meeting will be held Wednesday, January 7.
