Show The Garfield County Insider Page 4 December 24, 2008 LEGAL NOTICES NOTICE OF LANDFILL PERMIT RENEWAL TICABOO CLASS II LANDFILL Notice of Intended Disposition Garfield County has submitted a permit renewal application to continue operation of the Class II landfill located near the town of Ticaboo, Utah. The Class II landfill receives waste described in the permit application as non-hazardous solid waste, commercial waste, industrial waste, construction/demolition waste and special waste. The permitee is limited to an average of 20 tons per day of acceptable waste or a service area population of 8,900. The Division of Solid and Hazardous Waste has reviewed the permit renewal application and a draft permit has been prepared. Before taking action on the request, the Division is providing a public comment period to receive input. The public comment period on the draft permit begins December 24, 2008 and will end January 26, 2009. A public hearing may be held if, within 15 days of publication of this notice, a request is made to the Executive Secretary in writing and meets the requirements of Utah Administrative Code R315-311-3. Notice is here given in accordance with the Native American Graves Protection and Repatriation Act (NAGPRA), 43 CFR 10.6 (c), of the intent to transfer custody of Native American human remains and funerary objects in the control of the Bureau of Land Management (BLM), Grand Staircase-Escalante National Monument (GSENM), Utah. A detailed assessment of the human remains and funerary objects was made by BLM officials in consultation with representatives of the Hopi Tribe, the Confederated Tribes of the Goshute Reservation, the Moapa Paiute, the Kaibab Band of Southern Paiute, the Paiute Tribes of Utah, the Northern Ute Tribe, the Southern Ute Tribe, the Navajo Nation, and the Navajo Utah Commission. In April, 2008, human remains and funerary objects were removed from 42Ga6259,Garfield County, Utah. These remains were recovered in conjunction with an FBI investigation. No known individuals were identified. The funerary objects include metal artifacts. An analysis of the human remains and funerary objects indicates that this individual dates to the second half of the 19th century, probably the 1860s or 1870s. Officials of the BLM have determined that, pursuant to 43 CFR 10.2 (d) (1), the human remains described above represent the physical remains of one individual of Native American ancestry. Officials of the BLM have also determined that, pursuant to 43 CFR 10.2 (d) (2), the funerary items noted above were removed from the above burial site of a Native American individual. Lastly, officials of the BLM have determined that, pursuant to 43 CFR 10.6 (a) , the human remains and funerary objects were removed from lands that are recognized as the aboriginal land of the Kaibab Paiute. Representatives of any other Indian tribe that wishes to claim ownership or control of the human remains and funerary objects should contact Matthew Zweifel, Grand StaircaseEscalante National Monument, at (435) 644-4326, before January 30, 2008. Disposition of the human remains and funerary objects to the Kaibab Paiute may proceed after that date if no additional claimants come forward. UPAXLP Richfield Field Office Holiday Hours The Richfield Field office of the BLM will be closed for federal holidays on Thursday, December 25, Friday, December 26, and Thursday, January 1, 2009. These offices will be open Monday, December 29 through Wednesday, December 31 during regular business hours, and will resume regular scheduled hours on Friday, January 2, 2009. On December 12 President Bush issued an executive order directing that federal government agencies close their offices on Friday, December 26. The Friday closure isn’t unique for the BLM. His directive follows a tradition that dates to at least 1952. Since then, presidents have given government workers an extra day off when Christmas falls on a Thursday.
