Show 8 B DESERET NEWS, Wednesday, December 31, 1969 risible Victim, AAen Epidemic Is For Mishap, Ju Court U t a h's Supreme upheld the district court Tuesday afternoon in holding that four young men attemp'ing to rescue a car stranded because it had run out of gasoline were equally responsible for a fatal accident. The accident occurred May 13, 1968. about 22 miles east of Heber City on U.S. 40, where the car, operated by Craig Fuhriman. was stranded on the way back from Flaming Gorge Reservoir. Fuhriman and companion, Schocker Henry Lund, hitchhiked to Heber City. They were unable to obtain a container to carry (at 11 p.m.), but they induced Blaine Orvel Sweat and Ricky Allison to drive the vehicle operated by Alison to rescue the stalled car. The stalled car had been parked on the shoulder of the highway. They drove Allisons auto alongside the stalled car and parked on the highway facing east in order to siphon gasoline into the Fuhriman car. Indian Pageant Dated Measles They left their lights on with a llasher s gnal to warn traffic. A westbound car driven by Harold J. Sargent approached at about 65 miles an hour and swerved to the north to avoid the jeep, striking the stalled car which did not have lights burning. Sweat was fatally injured and his relatives sued the other three men. Sargent was not a party to the case. Justice R. I . Tuckett WTote the unanimous opinion. The four young men knew or should have known that their activities upon the paved portion of the highway placed them in a dangerous position should other vehicles approach from the east, Tuckett wrote. Each of the vourg men had the duty of avoiding harm to himself and it cannot be said that Fuhriman and Allison ow ed a higher or greater duty to protect Blaine Orvel Sweat from harm than the latter had to look out for his own well being, be added.
