| Show LEGAL d NN AN ORDINANCE GRANTING TO UTAH POWER AND LIGHT COMPANY ITS successors AND ASSIGNS AN ELECTRIC LIGHT HEAT AND POWER FRANCHISE the board ot of county commissioners ot of dox box elder county ordains as follows section 1 that there is hereby granted to utah power light company its successors and assigns herein called the grantee the right privilege or franchise until august to construct maintain and operate in ill along upon and across the present and future roads and highways in box elder cosily utah and its successors outside of incorporated cities electric light and power lines together with all the necessary or desirable appurtenances in ic luding underground conduits pole wires trans transmission missi on lines and telegraph and telephone lines for its 01 own use for the purpose of 0 supplying electricity to said county the inhabitants thereof and persons and corporations po rations beyond the limits thereat there bt for light heat power and other purposes section 2 poles shall be so erected as to interfere as little as po possible with traffic over said roads an and dhigh highways the location of all poles and conduits shall be fixed under the supervision er of the board of county commissioners ners of box elder county section 3 all lines constructed u under n this grant shall 3 constructed iu in accordance with established practices with respect to electrical construction section n 4 box elder county shall in ill no way be ba liable or responsible tor for arly any accident or damage that may occur in the construction operation or maintenance by the grantee of its lines and appurtenances hereunder and the acceptance of this franchise shall be deemed an agreement on the part of said grantee its successors and assigns to indemnity indemnify said county and hold it harmless against any and all liability loss cost damage or expense which may accrue to said county by reason of the neglect default or misconduct of the grantee in the construction operation or maintenance of its lines and app appurtenances ten ances hereunder section 5 the rho grantee snail file its written acceptance of this tran fran claise celse with the county clerk within thirty 30 days after its passage section 6 this ordinance shall take effect fifteen 15 days after its passage and upon acceptance as required herein passed by the board of county countr commissioners ot of box elder county utah this day of august 1916 JOHN F CONLEY chairman of the board of 0 county commissioners ATTEST ROYAL al JEPPSON county clerk and ex officio clerk ot of the board of county commissioners ners state of utah county of boxelder Box Elder ss 1 I the undersigned undersigner under signed the duly qualified and acting county clerk of box elder county utah and ex officio clerk of the board of county commissioners of said county do hereby certify that the foregoing is a full true and correct copy ot of an ordinance adopted by the board of county commissioners ners of said county at a meeting duly held therein on the day of august 1916 and that commissioners john F conley and albert E holmgren each voted for the passage or ol said ordinance aud and thomas IT II blackburn was not present and none voted against its passage IN WITNESS WHEREOF I 1 have hereunto set my hand and affixed a aed my official seal on this the day of 0 august 1916 |
