Show i 2 The Salina StTn, Wert January 27, 1988 So Kick Him Hard While following Editorial appeared in a February 1924 issue of the Gunnison Valley News. Times haven't changed, have they????? The An Editor is continually stepping on someone's toes. Most any old skinflint can stand on a street corner and say things that if the Editor said them;, would result in him being shot or run out of town - and all without benefit of a fair and impartial trial, to boot. But just let an Editor pen a few lines hitting some community wrong, oir some general shortcoming, and he has immediately trampled on a big bunch of tender corns. The owners of the corns are not a bit backward about " Editor an yelping and youre at it kicking! amended The Utah Senate amended a bill last week that would have taken away the requirement that counties publish the names of delinquent taxpayers in the local newspaper. The amendment to the bill left the requirement in place. The bill in question was a comprehensive property-ta- x reco- dification bill. The bills sponsor, Sen. Lyle Hillyard, made the amendent after much controversy erupted about eliminating the publication requirement. The element spawned strong opposition from the Utah Press Association, which complained local newspapers would lose a signi- - IN DRUG CASES ficant amount in advertising revenue if the requirement was removed. Newspapter publishers from around the state called their representatives to voice opposition. Recently, vehicles and equip- ment, apprehended in a recent drug find in Sevier county, had been confiscated, and the vehicle was forfeited. The laws of Utah provide that certain things are subject to forfeiture in connection with drug cases. The drugs themsel- ves, of course are forfeited. Any paraphernalia connected , with the drug use, and any conveyence used to intended to be used to transport or in any manner facilitate transportation, sale, receipt, simple possession, or concealment of prohibited drugs can be forfeited. Real property which has been used to warehouse or store drugs, or grounds used to produce or cultivate drugs can also be forfeited. All forfeitures are made to the State of Utah. Once a judge has found in court that some vehicle', cash or property meets the requirements for forfeiture, title to the property passes to the Director of Finance for the State of Utah. However, the seizing agency, or any law enforcement agency in Utah that can establish it has a need for the property and can use the property in enforcing the drug laws of the State, can apply for the property, and in most cases it will be awarded to them. The agency to which they go can decide how they will use them - or whether they will sell The vehicles and cash are items that come to the county without the expense of a great deal of public funds or tax money. In the appeal Taylor argued that the search of the yehicle by law enforcement officers was. in violation of the defendants right to privacy. He argued that as the ..iiurmaiion gained in the search had been obtained illegally, it could not be used as evidence. He f further argued that since neither of the two men in the vehicle Mountain Fuel Supply Company owned it, they had no right to has asked the Utah Public Service expect privacy and had no right to Commission to approve a $2,528-,00claim the search had been made reduction in its rates for Utah requirement. Tibbs had agreed with Brown and had allowed the information from the search to be used in the trial. Taylor also argued that the jury had been improperly instructed, and that there was question as to the validity of a California search warrant that had been used as evidence in the trial. Keep those vehicles off street says Chief Kiesel Recent heavy snows have made travel on area roads very hazardous, according to Chief Gordon Kiesel. Kiesel warns everyone to keep their vehicles off the roads so that the city crews can use the plows, and other equipment to keep them passable for all. Any vehicle, including cars, trucks, horse trailers, etc., left on the street for 14 days can be condemned and towed away, Kiesel emphasized. We ask everyone to cooperate to help keep our roads and streets safe for everyone to use, he said. Kiesel also reminds everyone that they must continue to remove ice and snow from their windshields. Since that time there have been literally dozens of such arrests and confiscations made in Sevier County - earning it the dubious title of Cocaine Lane. Attorney Don Brown says DeAlo will oe brought back to Sevier County and a new trial date will be set, unless DeAlo now pleads explanation of forfeiture of cash, vehicles, etc. Continued from Page Principal Christensen said the number of kindergarten students will decrease each year if the present trend continues. Christensen noted that enrollment trends are being considered with the possibility of moving the 5th grade back to the elementary school level. The 5 th grade now is part of the North Sevier Middle School, with grades 5, 6, 7 and 8. Christensen was asked to comment on the School Food Service program, especially since the kitchens were consolidated. Mr. Christensen said that he felt meal quality is very good, and reported that participation has actually increased. Ivan Rowley, principal of Richfield High, said that the Trimester program there is in its second year, and that the staff feels that the advantages far outweigh the disadvantages. Teachers of speech and FFA are concerned that the schedule does not enhance their programs. However, in a poll of the faculty, only one vote was against the trimester system. Rowley feels that the key to the program success is attitude, and the real strength comes from the unfair, unscrupulous meddler.
