school and the public of eureka permit me to make the following statement in regard to the basket ball game scheduled to have taken place between tintic gintic and the mil ard county high school on the evening of uary 15 on the floor of the hall I 1 was con fronted with the necess ty of either signing a statement which would have done dishonor to the team of the tintie high school or of dissat pointing the big audience pree pres nt r 0 have done the former ft have been to rel tel squish the respect of the players and of the townspeople to have assumed the duty of paying the expenses ot the visitors and to prove myself neglectful of my duty to have done the latter meant to hav incurred the displeasure of many and bring down a ra n of criticism upon myself millard demanded that I 1 s ga a statement as folio follo vs I 1 agree that this game is an exhibition game I 1 admit that I 1 have not a single elig I 1 ible player upon the floor in re turn I 1 offered to play under this agreement we agree to play this game under protest of eligibility the clintic players not being in possession of their cards or el and the of their cards of bleg ability and the to have signed the first would the man selected is in his stead mr thomas is wholly within the rules ot of the athletic association he ile is a former player on the eureka team tea m and is a duly registered student of tha th school to have sign signed edthe the second statement would have been to declare a truth this truth ho vever is in no wise a failure either of ignorance or malice on my part or the part ot of the tintic gintic high school or its team it could in no way have d fied our teams men for I 1 had performed my part of the work of registering the men in salt lake and had au thod the secretary treasurer oi the association to draw upon me for ANY expense NECESSARY to our plan to compete in the series ol 01 league games due to the failure of the mails to give prompt service he had taken no action in this mat ter up to the night before the game the delay of the mails made it im poss ble for me to fin sh the act 0 registering the men but further more there is not one word in th rules of the association said abou the eligibility cards the rule do not require that tha the mei be registered they require that the men shall be bona fide pupils of th school be of standard grade of schol i ar ship and be less than 21 deais old when the season opened the failure to have the cards is a fa lure to corn com ply with a recommendation of the board of control it is nat a viola tion of the rules at all the cards are merely evidence of the compliance with the rules in the above matters and further there is no date spec spee ifield in the rules as to when the dues must be paid and ana in any event my open order to the secretary treasurer is ample to insure our a rz p th s order was ex c tiled cited before our first game and it covered any empens of any nature which I 1 could not be expected to know until noti fied fled of its ex eXL istance Stance the fact that he has not taken advantage of it con vinces me that such an order was issued our intentions intent ioni declared and men to compete has been forwarded to the proper official of the association in salt lake I 1 claimed for our team the credit for the game and refused to pay the expenses of the team from fillmore the fillmore people remained away from the pavilion until the exact moment for the game to commence they donned their suits in their ho tel rooms in order to keep away from us and prevent us making any preliminaries until the house was full and the impatience of the audience should hasten our preparations chev wanted the audience to hasten ba b its impatience my decision and rob me nie of time to think and consult with our teams men they wanted a clear null hull fi cation of our rights and a tain victory in order to get a chance to play a tie with hinckley who now takes the championship of the divi s son on but even to satisfy the sp e gators I 1 take the ground that it wrong to submit to an im position even though this imposition exits as thrust upon us through their ignorance my corral ordence and the failure of the governmental ser vice the honorable thing to have done would have been for ane t e millard boys to play under the protest and leave the matter to the officials to decide whether I 1 violated any rules or not in awaiting my orders from the secretary treasurer before exe eating citing blanks which he had not sent me in view of my open order to the secretary treasurer and the delay of the mails for about ten days I 1 place my nay case before you and await the action of mr benn on of the U of U I 1 trust the people of eureka will see that I 1 did what I 1 thought
