city trolled the streets matched in numbers only by the number of peace Officers brought into the city to prevent any attempts to either kill Orchard or rescue Haywood and his companions who had been brought from Colorado for trial The trio had Clarence Darrow as while William E chief counsel Borah now senator from Idaho and the late Governor James H Hawley of Idaho conducted the prosecution The three mer we re acquitted Orchard was sentenced to hang but his sentence was later commuted to life Imprisonment Orchard Say Life Sentence Is Not Real Clemency In his application for pardon Orchard said it was no real clemency for the state to commute his sentence of death to one of life Imprisonment He said he understood when making the confession that he was to be hanged I wished to make myself right as far as was in my power before God and man for my past deeds I expected at that time to pay the penalty that the law provided But after sentence had been pronounced there was an effort started to have my commuted to lfe Imprisonment I used all the means within my power at the time to prevent this I refused to sign any application to the pardon board I wrote the governor not to consider such an application I also wrote to Governor Steunenberg s brother to use his influence to have the death penalty carried out all thl But notwithstanding mv sentence was finally commuted lo know life imprisonment I that the thought of the pardon board was to grant some measure of clemency for the testimony I had given for the state But when I look at it from a physical standpoint I have never been able to feel that I was granted any measure of clemency as I feel that life imprisonment without any or little hope of ever being free again is by far the greater puni hment and very often makes desperate men ” Orchard is 63 years of age having spent nearly a quarter of a century for the crime In the penitentiary Since incarceration he has written a book containing not only a long confession of the Steunenberg affair but a detailed record of previous crimes including several murders mine and railroad bombings principally in Idaho The next meeting of the board of pardons will be in September when Orchard s case will be considered It Is his second application for pardon the first one having been denied during the administration of Governor Davis about 10 years ago I Vhe-pi-
