Canyon Coal company appellant against Emil J Klemm In which $ JO 000 north of coal property In Sevier county Is Involved The supreme court opinion In upholding the decree of Judge W H Braniel of the Third district court held the property in question to beMines Acme long to the Boston company an tntervrnor In the action as soon as that company pays to the Sallna Canyon Coal company $38570 and 12350 to a development company These amounts It was shown had been paid by R L Lehman to Carl A Mattson and Barnard E Mattson for their coal claims at the time of the formation of the Sallna Canyon Coal company The record ehows that ten years ago Klemm the respondent negotiated with the Mattsons for the property as agent for the Boston Acme Mines company but did not pay the full contract price Lehmann appearing later completed the contract with the Mattsons and formed the coal company He had been active In promoting the Boston Acme company and now replaced Klemm In the transactions Bv the decree of the lower court Klemm and the Columbia Trust company Which had been made trustee under a mortgage to secure a bond Issue of 1500000 were held to have no interest The Salma Coal company filed
