The decision notice also called for issuing a new Special Use Permit to Sun Valley under terms of the 1986 Ski Area Permit Act. The decision was then appealed by Save Our Canyons, an environmental organization formed to protect the canyons along the Wasatch front. The forest supervisor’s decision was affirmed in October, 1994. In May 1995, Save Our Canyons filed a lawsuit to stop construction on the lift. A federal judge upheld that lawsuit and ordered the Forest Service to study the application more before issuing another decision” (USDA Forest Service Intermountain Region 2002 Planning Team 1997 Annual Report). Federal Intervention On June 16, 1995, Salt Lake City was named host city of the XIX Olympic Winter Games at the 104th International Olympic Committee (IOC) Session held in Budapest, Hungary. In response, pressure mounted for Utah Representatives and Senators to obtain needed federal legislation passed that would clench plans for the acquisition of USFS property in the Snowbasin area by the Sun Valley Company for private development of the ski resort. The federal legislation would be necessary to silence any further political, environmental or legal challenges to the project that might hinder the success of the co-dependent project between Utah leaders and Earl Holding to develop the world class area with downhill runs to accommodate the necessary Winter Olympic ski venues. In October, 1995, the Snowbasin Land Exchange Act was introduced in Congress and was passed in October, 1996 as section 304 of Public Law (PL.) 104-333, also known as the Omnibus Parks and Public Lands Management Act of 1996. The Act, which authorizes construction of Phase I facilities identified in the Snowbasin Master Development Plan (1995) on National Forest Service property, and an exchange of approximately 1,320 acres of public National Forest Systems land near the resort for private lands of equal value, was signed by President Clinton on November 12, 1996 (USDA Forest Service Intermountain Region 2002 Planning; The Nature of Discovery). The legislation passed with Congress determining that both the construction of the Phase I facilities and the land exchange were necessary and reasonable and limited in size and scope. The Act also stated that implementation of Phase I facilities were nondiscretionary actions that were directed by Congress and, thus, complied with all procedural and other requirements of the laws of the United States. Under this legislation, Phase I projects that were authorized by the Secretary of Agriculture are exempt from NEPA disclosure and are not subject to administrative or judicial review. The original proposal was heard by the House’s Subcommittee on National Parks, Forest and Lands, of which Representative Jim Hansen, RUtah, chaired. Hansen felt that the legislation would circumvent bureaucratic red tape. The Snowbasin bill was sponsored by Representative Hansen along with Utah Republican Senators Orrin Hatch and Bob Bennett. In the end, House Speaker Newt Gingrich, RGeorgia helped to successfully push the bill through the House on a unanimous voice vote (Standard-Examiner, September 26, 1995). Once the Snowbasin Land Exchange Act was signed by President Clinton in November of 1996, the Forest Service and the Sun Valley Company had sixty days to resolve any environmental issues that remained in the Master Development Plan. “Between mid-November and midJanuary, the venue prep team and Forest resource specialists worked with Sun Valley to develop an addendum to document mutually agreed upon changes to the Master Development Plan. The addendum was completed on January 14, 1997, and was delivered to the Washington Office and Under Secretary Jim Lyon’s office for a 30-day review. After one last 30-day Congressional review, the Snowbasin Land Exchange Act became law” (USDA Forest Service Intermountain Region 2002 Planning Team 1997 Annual Report).
