In Utah, to encourage landowners to allow the public free use of their land for hunting, special legislation has been passed protecting them from liability. These laws have the effect of limiting the care a farmer owes to a hunter. This encourages farmers to allow their property to be used for hunting without charge. If, however, a landowner receives economic benefit by charging a fee to come on his land, he has a duty to make the premises safe, or to post signs pointing out potential hazards. This is consistent with general law, which limits a landowner's liability where no charge is made. Whether you decide to charge a fee or not there are some additional steps you can take to protect your- self and your property. First and foremost interview every applicant yourself. During the interview, make it clear to whom you are giving permission and spell out the ground rules. One way to insure all these conditions are met is to use a written courtesy hunting permit.
