(2) Definitions: a. Boundary monument. Any physical object, regardless of type of material or marking, intended to represent a property comer of line, whether it be at the comer, on the line, or a recorded distance from the comer or line. b. Land Surveyor. A person who is qualified to practice land surveying, and who is licensed pursuant to et Utah Code Annotated, Seq., 1953, as amended, or who qualifies under one of the exceptions of U.C.A. 58-22-- 1, non-licensi- ng 58-22-- 1953, as amended. Section 2: Filing of Plats. (1) a. All land surveyors making a survey of private lands within Summit County which establishes or reestablishes any private property boundary monument shall file a map of the survey that meets the requirements of this ordinance with the county surveyor or other office designated fra such purpose. b. The map shall be filed and indexed fra public record and shall show: 1. The location by quarter section or lot number, section number, township and range. 2. The date of the survey, meaning the date the monuments were placed. 3. The scale at which it is drawn and a North arrow. When viewing the plate with the long dimension in a horizontal position. North or East must be to the top of the plat 4. The distance and bearing of all lines traced or established by the survey. If such a line is a curve, the radius, arc length, and central angle must be shown. If the curve is not tangent to straight lines at the point of curvature, the chord bearing must be shown as well 5. The basis of bearings fra the survey. The words "Basis of Bearing" must be shown rat the plat between two existing, described government monuments. Section 4: Penalty. (1) A violation of the provisions of this ordinance shall constitute an infraction, carrying penalties as provided by law. Section 4: Effective Date. This ordinance shall become effective fifteen (15) days after publication in a newspaper having general circulation in Summit County. NOTICE OF INTENTION TO ESTABLISH ECHO CREEK RANCHES SPECIAL SERVICE DISTRICT NOTICE IS HEREBY GIVEN THAT on October 19, 1988 the Board of County Commissioners of Summit County, Utah adopted a Resolution declaring that the public health, convenience and necessity require the establishment of a Special Service District, to be called "Echo Creek Ranches Special Service District" The Resolution also provides fra a public hearing on the establishment of the District in the Summit County Courthouse Commission Chambers at 5:00 p.m. on November 23, 1988. DESCRIPTION OF THE PROPOSED DISTRICT The District shall have the following boundaries: All of Echo Creek Ranches Subdivision as recorded in the office ot the Summit County Recorder including the following: Part of Sections 29, 30, A 31 and all of Sections 32 A 33 T. 4 N. PUBLTC HEARING ON PROPOSED ESTABLISHMENT OF SPECIAL SERVICE DISTRICT The Board of County Commissioners will hold a public hearing on the establishment of the District and the furnishing of road maintenance services therein at 5:00 p.m. on the 23rd day of November, 1988. Any interested person may protest the establishment of the District ra the furnishing of services therein cither orally or in writing at the hearing, at any time prior to the hearing, or within 15 days after the conclusion of the hearing. Written protests must be filed with the County Clerk, and may be withdrawn by the protestant at any time within 30 days after the hearing. Any protest signed on behalf of a corporation owning property in the District shall be sufficient if it is signed by the president, vice president, ra any duly authorized agent of the corporation. Where title to any property is held in the name of more than one person, all of the persons holding title to the property must join in the signing of the protest. At said public hearing, the Board of County Commissioners will give full consideration to all protests which shall have been filed and will hear and consider all interested persons desiring to be heard. The Board of County Commissioners may continue the hearing from time to time. After conclusion of the hearing, the Board of County Commissioners shall adopt a resolution either establishing the Echo Creek Ranches Special Service District or determining that the establishment of the District should be abandoned, or may, in its discretion, reduce the boundaries of the District and establish the District by resolution, as modified. If, within fifteen (15) days after the conclusion of the hearing, more than fifty percent (50) of the qualified voters of the territory proposed to be included within the District ra the owners of more than 50 of the taxable value of the taxable property included within the proposed District file written protest against the establishment of the proposed District or against the specified type of service to be provided within the District with the County Clerk, the Board is required by law, in the former instance, to abandon the proposed establishment of the District and, in the latter instance, to eliminate the type of service objected to from the resolution finally establishing the District - COMMISSIONERS James N.
