CITY OF EUREKA RESOLUTION AUTHORIZING THE FILING OF A PETITION TO OBTAIN ACCESS TO THE INTRASTATE PIPELINES OF QUESTAR R-99- METALMART a 1999. SHEETS ft 1200 E. 100 S. LEHI, UT L ORDINANCE 99-- 1 AN ORDINANCE DECLARING THE ANNEXATION OF TERRITORY TO OF MUNICIPALITY THE EUREKA CITY. WHEREAS, the owners of a majority of real property and the owners of not less than one-thir- d in value of the real property as shown on the last assessment rolls in territory lying contiguous to this municipality have petitioned this municipality for annexation; and WHEREAS, the petition was accompanied by an accurate plat or map of the territory to be annexed prepared under the supervision of the city engineer or a competent surveyor and certified by the engineer or surveyor; and WHEREAS, the petition and plat or map have been filed in the office of the municipal recorder. It is hereby ORDAINED by the Council of Eureka City as follow: SECTION 1. TERRITORY ANNEXED. The Territory annexed described in Exhibit "A" and Exhibit HB" is hereby declared annexed to the municipality; SECTION 2. Based upon the recommendation of the planning commission and pursuant to the Citys comprehensive plan, said property shall be zoned Sensitive Lands (SL) zone. SECTION 3. EFFECTIVE DATE. Regardless of Past Credit History -4 GAS COMPANY LOCATED IN THE STATE OF UTAH FOR THE PURPOSE OF TRANSPORTATION OF INTERSTATE GAS TO BE USED BY THE CITIES OF COLORADO CITY, ARIZONA; FREDONIA, ARIZONA; KANAB, UTAH; AND THE KAIBAB-PAIUT- E INDIAN RESERVATION the Federal Energy Regulatory Commission ("FERC") has jurisdiction over the transportation of interstate gas over intrastate pipelines which proceed across state lines into interstate commerce such as would occur in a petition to be filed before FERC by the Cities of Colorado City, Arizona; Fredonia Arizona; Kanab, Utah and the Kaibab-Paiut- e Indian and Reservation; WHEREAS, the cities of Colorado City, Arizona; Fredonia, Arizona; and the Kaibab-Paiut- e Indian Reservation are willing to create and interlocal WHEREAS, agency agreement and other agreements for the establishment of an interstate pipeline and municipal gas utility through which they would act in support of the filing of the above said Petitions and Kanab, Utah is willing to become a member to the Utah interlocal agency known as the Intermountain Gas Agency; and WHEREAS, a Petition requesting a Declaratory Order on the subject of the right to the transportation of interstate gas across portions of the Questar Gas Companys ("QGC") intrastate pipeline in southern Utah is a matter of great public interest to all municiplities who are or may become engaged in the operation of municipal utilities and desire to use interstate gas; NOW THEREFORE, BE IT RESOLVED that the City hereby authorizes Wheatley & Ranquist, a Maryland law firm acting inconcert with Nielsen & Senior, a Utah law firm, to cause to be filed a petition with the FERC on behalf of all of the cities who are members of the Intermountain Municipal Gas Agency ("IMGA") and on behalf of other interested parties seeking a declaratory judgement establishing the right to access for the transportation of interstate gas through the portion of QGCs pipelines located in southern Utah necessary to deliver such as to the Hildale City pipeline connection at Hurricane, Utah.
