OF FIMETHOD NANCING Pursuant to the provisions of the Utah Special Service District Act, Chapter 2, Part 13, Title 17A, Utah Code Annotated, 19S3, as amended, and Article XIV, Section 8 of the Constitution of Utah, the district may annually impose fees and charges to pay for all or a part of the services to be provided by the district. It may also annually levy taxes upon all taxable property within the district to provide the proposed services and may issue bonds for the acquisition andor construction of facilities or systems to provide said services, provided, however, that said levy to provide said services or to repay said bonds must be authorized and approved by a majority of the qualified electors of the district at an election for that purpose. PUBLIC HEARING T ON PROPOSED OF SPECIAL SERVICE DISTRICT The Board of County Commissioners will hold a public hearing on the establishment of the district and the providing of garbage and fire protection services within the district at the Duchesne County Courthouse, 30 East 100 South, Duchesne, Utah, at 3:00 p.m. on December 10, 1996. Any interested person may protest the establishment of the district or the furnishing of services therein, either orally at the hearing or in writing, at any time prior to the hearing. Written protests must be filed with the County Clerit and may be withdrawn by the protestant at any time before the County establishes or abandons the district Any protests signed on behalf of a corporation owning property in the district shall be sufficient if it is signed by the president the vice president or any duly authorized agent rtf the corporation. Where title to any property is held in the name of more than one person, all of the persons holding title to the property must join in the signing of the protest. At said public hearing, the Board of County Commissioners will give full consideration to all protests which shall have been filed and will hear and consider all interested persons desiring to be heard. The Board of County Commissioners may continue the bearing from time to time. Whiting Over the past ten years Duchesne County has handed over about a million dollars to attorneys to pay the costs of litigating the Indian jurisdiction issue. Last week they asked South Dakota attorney, Tom Tobin, to reduce his bul saying that Tobin neglected to obtain prior authorization before treking up $119,000 in legal expense! over the past five months in preparation for Septembers hearing before die 10th Circuit Court of Appeals in Denver. The legal bill if bring divided with Uintah County, but Duchesne County still owes $23,701 to pay off their share of the debt. Uintah County has reportedly already paid their half of die legal tab. Tobin, who specializes in Indian law, was retained over ten years ago to represent Duchesne County in jurisdiction litigation. During a telephone conference last Tuesday, county commissioners asked Tobin for a reduction in his fee, saying that he had been instructed earlier to keep the trill wound $70,000 total, but had proceeded to tally up unauthorized hours.
