We deplore discrimination. We believe jobs, housing education should be granted without regard to race, color, creed, sex or national origins. because of basic belief that we also deplore affirmative action programs. A law that prohibits discrimination on the one hand and requires it on the other is as distasteful to us as the original discrimination. Thus we have watched the case of Allan Bakke, whose entrance into medical school at the University of California was blocked because of an affirmative action program "color quota", with interest. The Supreme Court of the United States ruled in the case early this month. At least they published a volume of pregnant prose which passes as a decision. Points of this ruling agree absolutely with our philosopy. Justice Lewis Powell stated, "The guarantee of equal protection cannot mean one thing when applied to one individual and something else when applied to a person of another color." Right on. But the decision falls short of a definitive defense of that principle while the final decision says racial quotas are forbidden, it wavers and allows that race may be an "element" in judging students for admission to universities, putting its stamp of approval on affirmative action programs. Some have lauded this as wise, removing It is this quotas but allowing colleges to recruit students from all races in an attempt to wipe out problems that face the nation's minority groups. We see it as an administrative nightmare. Those who are to set admissions standards for colleges may well read the Bakke decision and end up saying, "What?" We feel the justices have hedged their responsibility and, once again, the decision will end up being made by bureaucrats. Someone in the federal Department of health, Education and welfare will write up a regulation consistent with what he or she feels the Supreme Court decision should mean. And the public will have to live with it until someone else challenges that regulation or some college's application of that regulation and we'll have to start all over again. Perhaps it is impossible to have real equdli-ty- . Perhaps the past history of unfair treatment of some peoples has mired them so helplessly in poverty and apathy that real equality cannot overcome their current problems. But reversing the discrimination, we feel, can only create more problems, more resentment. It is our hope for the world that people, as well as the law, can become "color blind" in providing opportunities in jobs, education, housing, etc., and that we can pull ourselves up to a true equality without the benefit of a bullying bureacracy. In the event you have ordered merchandise by mail and waited a long time to recieve it, or never received it at all, you should be aware of your rights of protection under a ruling by the Federal Trade Commission. To know when you can expect your merchandise to be shipped. If an ad or brochure says that the manufacturer will rush your merchandise to you in less than a week, for example, the manufacturer must ship it to you in that time. If no date is stated by the seller, you have the right to have your merchandise shipped to you within the stated time, or within 30 days.lf the seller does not ship your merchandise within the stated timee, or within 30 days. . . To cancel your order. If the seller can't ship the merchandise to you in the stated time or wilhin 30 days, he must give you the chance to cancel your order and get all your money back. The seller must notify you of a delay and give you a free means of reply (for example, a postage-pai-d postcard). the shipping delay is 30 days or less, you have the right to cancel the order and get you money back, the right to agree to the new shipping date or the right not to answer. If you don't answer, the seller can assume you agree to the shipping delay. If the shipping delay is more than 30 days, you must give your express consent to the delay. Otherwise, the seller must return your If 43 VI H m r7i money at the end of the first 30 days of the delay. To get all your money back if you cancel. The selldr must mail your refund to you within seven business days after you cancel your purchase. Where there is a credit sale, the seller has one billing cycle to "adjust" your account. The rule does not apply to services like mail order photo finishing; magazine subscriptions and other serial deliveries except for the initial shipment; mail order seeds and growing plants,- "collecting on delivery" orders,- - credit orders where the buyer's account is not charged prior to shipment of the merchandlans (e.g. book clubs) where you must notify the seller of your intent not to purchase. In all other instances it is illegal to send you merchandise through the mails unless you have previously requested it. They always fail to point out that of the 35 states; 4 states, Idaho, Nebraska, Tennessee, and Kentucky have rescinded their prior ratification. This means that only 31 states now have ERA on their books. More states are considering rescinsion. 2. The stales of Indiana and North Dakota orginially voted down ERA but were able in a later vote to get ratification. These two states are of course included in the total ratification count. You can vote it in but you cant vote it out. As Jake Garn says, in this battle only one side can score point In the event that someone should question this reasoning, the bill that came out of the House Judiciary Committee on July 18 specifies that there can be no rescinsions. 3. Not only has Utah spoken on this question, but as you can see, so have all of the unratified slates. 4. ERA supporters tell ua that a majority of the people favor ERA. However, in 1975 New York and New Jersey put ERA on the ballot and it lost in both states. When the Nevada legislature decided to put ERA on the ballot, the feminists went to district court to prevent a vote. Utah citizens arc being made to feel that they are alone on this question when that is very much not the case. 5. The extension question is more than a threat to those who dont want ERA. Bril The community is bustling with activities, or have you noticed? Dr. VarneD Bench is doing a fabulous job with the preparations for UBIC 1978. Those associated with him are to be congratulated for their efforts. I know much time and effort is being expended for the festivities this year. Enough can't be said for the community effort put in to the Annual U.B.I.C. o There has recently been a of the decision regarding the Duchesne County Commission red garding their withdrawal from Travel Board. I feel that there are too many people who are not fully aware of the entire travel region concept and due to this unawareness many wrong impressions are formed. The County commission based their decision on a brochure which was published by Dinosaur land Travel Board, only a small portion of their entire program. This brochure did not publicize Duchesne County well. ..I had to agree with them on that point, when they became fully advised of the entire program they promised to give the matter another look. This is pre-U.RI.- lot-to-d- Dino-saurlan- Wish commendable of the commission. I believe that we are interested in Duchesne County and the Region a whole, what is good for one is good fw the other. I spent a couple of days with Milt Jolley, Assistant Director of tho TYavel Council, meeting with the County Commissioners and the representatives of Duchesne City, Duchesne Chamber and Roosevelt City Chamber as well as others. Those were two very fruitful days...the total program of Dinosaurland Travel Board was explained and I believe, understood more fully. Milt felt good about tho reception we got and so did L We have planned a meeting with the CommisTravel Board, sion, Dinosaurland Duchesne City and Duchesne Chamber officials and representatives from Roosevelt City and Roosevelt Chamber of Commerce. This meeting will be conducted by the Travel Council. Phil Keene, Director, and Milt Jolley, Assistant Director, will be present to explain the total Utah State Regional Concept We feel that the only way in which we can work aa one body is to have more communication and better understanding of tho program...we hope this can be accomplished at our meeting. A complete knowledge of the entire picture is a necessity before forming any opinions, and that is my hope; that we can put all of the cards on the table, discuss the matter and then make some decisions. I worked with Dinosaurland Travel fw a couple of yean before I became fully aware of tho total program, S': where the region fit in with the Travel fii Council and how it worked as a whole in the State. Until I began working for the Chamber and became associated with Dinosaurland Travel Board I had never really heard of Dinosaurland Travel Board and did not know its function. WelL..I guess what I am trying tossy is that we need to get all the facts as a public before we form too many opinions, see the entire picture and then go from there. One thing la fw rare, we need to be united in the things we are doing in promotion of our area and not. duplicate our efforts if possible.
