Chapter 3 Scope of Ordinance, Variances, and Exemptions Scope of Ordinance (1) No parson shall subdivide any tract of land which is located wholly or in part in Altamont Town except in compliance with this Ordinance. No person shall sell or exchange or offer to sell or exchange any parcel of land which is any part of a subdivision of a larger tract of land, nor offer for recording in the office of the County Recorder any dead conveying such parcel of land, or any interest therein, unless such subdivision has bean created pursuant to and in accordance with the provisions of this Ordinance; provided, that this Ordinance shall not apply to any lot or lots forming a part of a subdivision created and recorded prior to the effective dale of this Ordinance, except as provided in (2) below. 3-- 1 (2) No lot with in a subdivi- created and recorded prior to the effective date of this Ordinance or approved by the Planning Commission and Governing Body and recorded in the County Recorder's office under the provisions of this Ordinance, shall be further divided, rearranged, added to or reduced in area, nor shall the boundaries of any lot be altered in any manner so as to create more lots than initially recorded, or any sion lot, without approve disapprove the ftelimalnary Won, or approve it with modification within thirty (30) days from the dote of the sub mission of the Preliminary Plan to it. The action of the Commission Planning shall be written on the face of two capias of the plat; one of which shall be retained in the files of the Planning Commission, and one of which shall be returned to the subdlvlder. Note: The Preliminary Plat, along with the engineering drawings, may be presented to the Planning Commission at the same time as the Vicinity Plan. Where a subdivider owns or controls more land than he wishes to develop immediately, the Planning Commission may a require that Preliminary Plat of the whole area be submitted in which case the subdivider shall on the Prelimianary Plat the portion to be developed immediately, and the portion to be held for future clearly demonstrate that, because of peculiar physical conditions pertaining to his land and not to other lands in the general area, the litoral enforcement of one or more of the regulations of this ordinance is impractical or will cause undue hardship, and where a subdivision would other wise be permitted, the Governing Body, after favorable recommendation of the Planning Commission, may permit such variance or variances as may be reasonable and within the general prupose and intent of this Ordinance. The owner or agent of the owner of a trad or parcel of land proposed to be divided Into fewer than ' ten (10) building sites, tracts, or lots, shall apply to the Planning Commision far designation of the development as a minor shall contain the following formation: A. Subdivision Sketch Plan The Sketch Plan shall show a simple sketch drawn to scat s of the proposed layout h of streets within mile of the subdivision. The plan shall be prepared at a scale of nut smaller than one Whenever final approval has been obtained on any part of an approved Preliminary Plat shall remain in effect for a period of one year. Thereafter, approval of the Preliminary Plat will have expired unless a Final Plat has been submitted to the Planning Commission or a another tracing. Final plats shall not be required where all the following conditions exist: (1) The subdivision consits of fewer than ten (10) los. (2) The subdivision does not require the dedication of any land for street or other public purposes. (3) The subdivision is not traversed by the mopped lines of a proposed street or a street to be widened, os shown on the Master Plan or on the Official Map. (4) Each of the lots in the subdivision meets the frontage, width and area requirements of the zoning ordinance, or hut been granted o variance from such requirements by the Board of Adjustment under powers of the Board granted in the Zoning Ordinance. (5) The lots are not part of a mioor subdivision approved less than three (3) years earlier. Platting and Recording 4-- 4 B-- 2 shall be made on a scale large enough to dearly show all details, and the workmanship on finished drawings shall be heat, clean pul, and readable. The subdivider shall also furnish Ihe Planning Commission with two (2) prints of the final plat when submitting the CHARIER After the Preliminary Plat has been approve, the sub divider shall then prepare and submit one tracing and two copies of the final plate of the subdivision to the Planning Commission. A written application for approval of the final plat on forms furnished by the Planning Commission shall also be submitted with the final plat. Conformity to these Regulations Sketch Plans, Preliminary Plats, and final Plate shall all conform to the requirements and specifications of these regulations, and shall be sub milled in the manner prescribed.
