Show JA-I JA re now V with the sewer By the Ephraim City Council There has been much discussion dis- dis discussion discussion dis dis- and misunderstanding relative to sewer service charges paid by Snow College to Ephraim City In order to clarify some of these the fol following following following fol- fol lowing facts are presented The rates paid by Snow College College College Col Col- lege were by an agreement made between the City and Snow College College College Col Col- lege and with the consent and understanding of the bond hold hold- ers This agreement was binding binding binding bind bind- ing with no time limit or provision provision provision pro pro- vision for change written in the contract The agreement was entered into before the sewer was built and the terms of the agreement fit tit the conditions then existing On February 9 1970 it was brought to the attention of the Council by Councilman Clayton Peterson th that t sewer Income did not meet sewer expenses The Council felt that something should be done to protect the loan from the Cemetery Perpetual Perpetual Perpetual Per Per- Care Fund and also to bring the sewer income to meet the bond ordinance require require- ments After much study In in- in P N of what other cities have done computations of ex existing existing existing ex- ex rates and several analyses ses of Increased rates decisions decisions decisions deci deci- were made to meet these two objectives protect the Perpetual Care Fund and meet bond requirements To do this several things were done Rates were raised to all users except Snow College College College Col Col- lege which was paying as per contract Before these rates were raised meetings had been held with Snow College beginning beginning beginning begin begin- ning in the early spring of 1970 to explain our problem and request a new agreement After a number of meetings and more study an agreement was reached ed and signed by President Floyd S. S Holm and Mayor Vertis Nielson on March 11 1971 In arriving at a basis of payment all parties felt feIt that some formula based on the amount of flow now contributed by Snow College compared to the total flow now into the sewer should be used After Installing a re recorder recorder recorder re- re corder at the sewer plant and having the City Engineer analyze analyze analyze ana ana- the readings over a period N. of time when school was in session and when it was not in session a basis of around 25 of the flow now and sewer costs was agreed upon Using this basis to work out a formula the substance of the agreement reached is as follows The City feels that all users of the system should pay a fairand fair fairand fairand and equitable service charge to meet the costs of the tem Snow College desires to pay its fair share of the service charges for the sewer Terms of the agreement 1 The College shall pay for all housing units at the same commercial rate as other users 2 The College shall pay for Institutional Buildings at the same rate as other schools presently using the sewer facil facU- ity The method of payment for services shall be as follows 1 All housing units will be billed monthly and payment will willbe be made by the College as soon as it receives the billing from Ephraim City Should the College acquire by construction or purchasing additional housIng housing housing hous hous- ing units such additional units will be charged at the com- com merical rates In effect at the time of said addition 2 2 Service for Institutional Buildings will be billed quarterly quarterly quarterly terly for full time equivalent students and staff for the quarter quarter quarter ter Just past at the rate of ot 12 per person per month or 36 per quarter The parties agree that when these rates are either raised or lowered that the same willbe will willbe willbe be done upon a basis of all other users of the system being raised or lowered and that such raising and lowering will be on onan onan onan an equal and equitable basis to all users users' This agreement shall take ef effect effect effect ef- ef on the 1st day ot July 1971 This new agreement will bring about per year inser- inser in service service ser ser- vice charges from Snow College College College Col Col- lege based on this years year's en en- en This represents an Increase over the contract now In effect of about |
