On July 3, the Citizens rom-it tee filed a petition for writ of prohibition In the Supreme Court of Utah In which they stated that the bonds had been issued and delivered without proper authorization, and that they were therefore illegal and void, and therefore the Provo city officials should be enjoined from spend' Ing the money received from these bonds. This petition contained much stronger allegation! than the petition recently heard In the District Court in Provo, but the judges of the Supreme Court after studying the petition re. fused to issue a writ of prohibition. Again on July 11, 1939, the Citizens' committee attempted to obtain a writ of mandate against Mr. Benrh to compell him to take the necessary steps to submit ordinances for approval of the voters. That very same day the Supreme Court denied this petition, by which act the Court, In effect, said that the ordinances passed on June 29 were alright, being merely administrative, and within the power of tha City Commisaon to pass, and could not be referred to the people.
