While both bills provide that land use planning will begin at the local level, it is clear that non-locinterest must be allowed to review and approve local land use plans. The citizens who do not want the federal funding have very little other choice. If a state does not develop a plan with adequate land use controls, federal monies will be al withheld until the state does submit an acceptable land use plan. The desirability of land use planning is not the key issue. The major issue is whether a federal land use planning program is needed and a sound approach to land planning. Many state constitutions provide that only county governments have the right to regulate land use. The Congressional Committee Minority Report says there are federal constitutional lawyers who maintain there is a similar provision in the United States Constitution.
