Show FRIDAY, JULY 23, 1971 Page Twelve Bennett Joins In Sponsoring Interstate Taxation Act Lloyd Signs Discharge Petition For Prayer Amendment Rep. Sherman P. Lloyd, announced that he had signed a discharge petition which, if successful, would bring a constitutional amendment allowing prayer in public schools buildand other onto House the floor for a ings vote. I am happy to join with other concerned members of the House in trying to bring this amendment to the floor where the entire membership can vote on it. I hope that the amendment can be passed and ratified as soon as possible so that we can regain a proper perspective concerning prayer in our schools and other public buildings, Lloyd said. Since the 88th Congress, numerous joint resolutions proposing a Constitutional amendment to assure the right of prayer in buldings have been introduced in both the House and Senate. Unfortunately, the prayer has never been refor consideration ported by the full House membership, in spite of obvious public approval and support, he said. The petition requires 218 signatures, a simple majority of the House, to bring the amendment to the floor. At the present time the amendment is tied up in the Judiciary Committee by Chairman Emanuel Cellar, who is opposed to the measure. In the almost nine years since the Supreme Court first made the decision that had the effect of banning public prayer and Bible reading from many of the nations classrooms, two other discharge petitions have been filed, but have failed to obtain the necessary number of signatures. The first attempt was in 1964 and the second attempt came at the end of the session last year. R-Uta- tax-support- ed tax-support- ed D-N.- Y., h, Even though filing a discharge petition is not a popular move in Congress, I feel that the time has come for the Congress to take some action, and this seems to be the only avenue left open to us, Lloyd said. It is interesting to note that although more than a majority of the House have introduced or sponsored prayer amendments, there seems to be no great drive among those ostensibly backing the proposal to sign the motion that would get it to the floor for a vote, Lloyd pointed out. The Utah Congressman is optimistic, however, that this discharge petition will be succssful. The mere fact that it has been introduced early in the session gives it a much better chance of succeeding, he said. If the 218 signatures are obtained, the measure still would need a margin of victory in both houses to be sent to the states for ratification. Three-fourtof the states would then have to ratify the amendment within seven years of its passage. Lloyd and those backing the petition think that if the bill ever clears the Congress the people will pass it. The bills aim; he said, is to help assure uniform and equitable tax treatment of business firms operating in two or more states. The idea of such a compact has increasing appeal among states, as demonstrated by additional states that have joined the multistate tax compact, which Congress is being asked to approve in our legislation, Sen. Bennett explained. The Senator noted 22 states, including Utah, have enacted the tax compact, compared to 16 states in February, 1969, and only 4 states in April, 1967. Sen. Bennett said the Interstate Taxation Act, which he is with Sen. Warren G. Magnuson, was prepared under the auspices of the Council of State Governments and the Advisory Commission on Intergovernmental Relations. The compact establishes mechanisms for meeting multistate tax problems on a continuing basis and for solving future problems as they arise, Sen. Bennett said. The compact deals with such problems as income, capital stock, gross receipts, and sales and use taxation. Sen. Bennett explained the compact helps provide national tax uniformity by providing a formula which multistate firms could use to determine the percentage of their income that may be taxed in any state. The compact also provides an arbitration procedure for the settlement of disputes.
