Notice of said election shall be published once a week during three consecutive weeks, the first publication to be not less than 21 nor more than 35 days before the election, in the Summit County Bee, a newspaper having general circulation in North Summit School District. Said notice shall be in substantially the following form: NOTICE OF BOND ELECTION THE BOARD OF EDUCATION OF NORTH SUMMIT SCHOOL DETRICT, UTAH PUBLIC NOTICE IS HEREBY GIVEN that a special election will be held in North Summit School District, State of Utah, on the 21st day of May, 1968, at which election there shall be submitted to such quali- necessary apparatuses for improving school property under the charge of the Board of Education? Immediately after appointed to conduct the election shall proceed to count and canvass the votes and shall promptly thereafter certify the result to the Board of Education, and the said Board of Education shall not later than 10 days after the election, meet and canvass the votes and if a majority of votes cast at such election are in favor of the proposition submitted, then the Board of Education shall cause an entry of that fact to be made upon its minutes, and thereupon this Board of Education shall be authorised to issue such bonds. Only qualified electors of North Summit School District as shall have paid a property tax therein in the year preceding such election shall be permitted to cast a vote at such election. Any person applying for a ballot at the polling place designated for the conduct of such election who is not challenged and any such person whose qualifications to vote are challenged by any one or more of the election officials or by any other person at the time the ballot is applied for shall receive a ballot and be entitled to vote if (1) such person is shown on the Bonds. If the voter desires to vote against the proposition he shall mark a cross (X) in the square opposite the Issuance of LEGAL RESOLUTION WHEREAS, there is an immediate and pressing need of raising money for the purpose THEREFORE, Be It Resolved by the Board of Education of North Summit School District, Summit County, State of Utah: Section 1. In the judgment of the Board of Education, it is advisable that an election be called and held pursuant to the Utah Municipal Bond Act in the district to submit to the qualified taxpaying electors of the district the question of whether bonds of the district in the amount of $1,050,000 payable not more than 20 years from their date and to bear interest at a rate or rates not in excess of 6 per annum shall be issued and sold for the purpose of raising money for purchasing school sites for building or purchasing one or more school houses and supplying the same with furniture and necessary apparatus, and for improving school property under the charge of the Board of Education. Section 2. The said question shall be submitted at a special election of qualified electors of said school district who are record owners of property and have paid a property tax therein in the year preceding such election. The election is hereby called to be held in said school district on Tuesday, the 21st day of May, 1968. The question submitted shall be substantially the form set out in the form of ballot appearing in Section 5 hereof. Section 3. The election shall be held in the district, and the polling place within the district and the electors and Judges who are hereby appointed to conduct the said election are those specified in the form of notice set out in Section 6 hereof. Section 4. At said election the polls shall be opened at the hour of 7:00 oclock a.m. and closed at the hour of 8:00 oclock the Issuance d Fawn Smith Irene Rowser Wilda Birch, Alternate. The pedis at the polling place shall be opened at the hour of 7:00 oclock a.m. and will be kept open until and will be closed at the hour of 8:00 oclock p.m. There is to be no special registration of voters for such election and the official register last made or revised shall constitute the register for such election, except that the County Clerk of Summit County shall register at his office during regular office hours except Saturdays, Sundays and holidays and except during the ten-dperiod immediately preceding the bond election any person who on the date of the election will be a qualified elector and will register such persons as provided by law. The County Clerk will make available or will cause the registration agents to make available at the above described polling place a registration list or copy thereof listing all registered electors entitled to use such polling place. s Harvey E. Pace ay INH WOK MTUIfl Cl, CMCWait, wo. re- gistered voter in Summit County, and (2) such person (a) signs an oath sworn to before one of the election officials that he is a qualified elector of North Summit School District and has paid a property tax therein in the twelve months preceding such election, or (b) produces a tax receipt showing that he owned of record property in North Summit School District, Summit County, on which he had paid a property tax within the twelve months preceding the election. Each of the election officials is expressly authorized to administer such oath in accordance with the provisions of Section 6 of Chapter 14 of Title 11, Utah Code Annotated. In the case of any such challenge or challenges, the election officials shall keep a list of the names of each person challenged, the grounds for such challenge, and whether such person was permitted to vote. Such list shall be made in duplicate by the election officials at the polling place and after the closing of the polls a duplicate list shall be returned to the school board by the election officials so that such duplicate list will be available to the said school board when it canvasses the election results. Section 8. The County Assessor and County Treasurer or such persons as they may designate, are hereby directed to check the registration lists against the tax rolls of Summit County and indicate on the registration lists by appropriate mark the names of the electors shown thereon who paid a property tax in the twelve months preceding the election. Section 9. The oath referred to in Section 7 hereof shall be in substantially the following form: ELECTORS OATH STATE OF UTAH ) COUNTY OF SUMMIT ) The undesigned, having been first duly sworn upon oath, deposes and says under the pains and penalties of perjury, as follows: That I am a citizen of the United States and have been so for not less than ninety (90) days; that I am of lawful voting age; that I am now and have been a resident of the state of Utah for not less than one (1) year of Summit County for not less than four (4) months, and of the voting district or precinct of North Summit School District in which I am offering to vote for not less than sixty (60) days; that I am a duty registered voter of Summit uwi mm m moot, hi gun haul wbtl and I am a qualified voter of and reside within the confines of North Summit School District; that 1 own property located in North Summit School District, title to which is held in my name, and that I paid a property tax thereon during the twelve months preceding this election; and that I have not previously voted at the bond election being held on this 21st day of May, 1968, in North Summit School District, Utah. The Board of Education hereby provides and directs that this resolution be published one time in the Summit County Bee, a newspaper of general circulation in Summit County, Utah. For a period of thirty days after such publication, any person in interest shall have the right to contest the legality of this resolution or any action taken pursuant thereto, but after such time no one shall have any cause of action to contest the regularity, formality, or legality thereof for any cause whatsoever. Section 11. All acts and resolutions of the Board of Education in conflict with this resolution or any part thereof are hereby repelled. Section 12.
