J. Reese Hunter Editors Outlook Dangerous Precedent Set by Idaho Judge A dangerous precedent has been set, but hopefully not firmly established, by District Judge Alfred C. Hagan of the Fourth Judicial District of Idaho, as he signed a restraining order on July 20th against the International Silver Mint Corporations sales methods. The judge stated that: sales techniques is the fear' or scare' technique concerning the alleged uncertainty of the future of the United States economy. The technique goes to the extent of One of the defendant's main the predicted collapse of the entire monetary system of the United States. So, what else is new, Your Honor? Sometimes there is nothing more scary than the truth. If Mr. Robert Preston, speaker for International Silver Mint Corporation, told his audiences the truth about the economic situation in America today and they were scared by it, does that mean that Preston should be enjoined from speaking the truth? Apparently so, according to the judge. Anyone who has any of his five senses left can certainly feel there is something wrong with our money today even though he may not understand what it is. Since President Franklin D. Roosevelt violated the Constitution and called in all our gold, our nations money has been holding a precarious position. After Roosevelt helped to get all our gold into one place by taking it from American citizens by law and by buying it from foreigners at $35 an ounce (when its going market value was $20 an ounce), the conniving International bankers then siphoned the gold out of this country and put us on fiat paper money. Our Founding Fathers knew that Fiat, or paper money not backed by gold or silver, was a fraud and invariably led to runaway inflation and finally monetary collapse. They had a bitter experience with it when the earlier Continental Congress issued paper money. As the inevitable inflation ensued, the Continental money became so worthless that the expression Not worth a Continental developed and is with us even to this day. Armed with this foreknowledge, the fathers of this country wrote into the Constitution that: No state shall . . . make any Thing but gold and silver Coin a Tender in Payment of Debts; ... Constitutional money was therefore hard currency. In 1968, Congress passed a law that finally sealed the fate of the American dollar w'hen it removed even the last 25 gold backing from the dollar. Up until that time, theoretically at least, each paper dollar was supposed to have 25 of it backed by gold. After 1968, the American dollar had nothing of intrinsic value backing its paper money. In urging Senator Wallace Bennett to vote against removal of the gold backing in 1968 (Both Bennett and " We just want to give you more security" Congressman Sherman Lloyd voted to remove the gold backing), your editor ended his plea with a statement something like this: KeodeFS removed, the old Not expression Not worth a Continental' will be changed to. worth an American dollar. If the 2596 gold backing of our dollar is Because of the policies our government has followed, the ultimate fruition of that statement is inevitable. coins were Under President Johnson, worthless wafer minted. Almost immediately (in accordance with sound economic theory), the bad money drove the good money out of in our nation circulation. Silver money is almost began to hang on to today. Those who had any money-sens- e whatever silver coins they could find and the government grabbed up the rest of it from the banks as fast as they dared. As a result, Americans have been gypped out of about 23 cents of every non-existe- Now, what have Bob Preston and International Silver Mint Company been doing? They have been telling people to begin to prepare for the coming economic crash by investing in land, food, and silver. Sure, they made a living selling silver, but so what? The government minted and then sold Eisenhower dollars (40 silver) at $3.00 each and bragged about the money they were making. That would be approximately $9.49 per Troy ounce for the amount of silver in the coin. This is far more expensive than the $2.50 per ounce International Silver Mint charges for silver ingots silver. Even the bank of Idaho, and others, have which are 99.9 sold sterling silver ingots (sterling silver is only 92.5 silver) in 1000 grain ingots at $12.50 each, or about $6.49 per Troy ounce. Did International Silver Mint Company lie about or cheat on the quality of silver they sold? Even the judge could not find that they did, since he stated: I cannot find, by a preponderance of the evidence, any positive factual misrepresentation concerning: 1. silver as a saleable or useable commodity ; 2. the quality of the silver offered for sale by the defendant; 3. the uses of silver as a product. The Utah Independent substantiated the above statement of Judge Hagan by interviewing two customers of International Silver Mint Co. One customer stated that the company had performed exactly as they stated. He simply paid them cash and they gave him silver for it. What could, be simpler or more straightforward than that? The other customer we interviewed went so far as to test the silver he purchased from International Silver Mint Co. He had an independent assay run on a 3 ounce silver bar and received the following report dated April 11, 1972: The silver bar may be more pure than 99.93 but the in is this not equipment laboratory capable of determining whether or not the purity is greater than 99.93. We do certify that the bar is at least as pure as is indicated on the bar, i. e. , .999 fine which is pure. of bar prior to removing about 0.15 grams for analysis: 95.36018 grams which is 3.06590 Troy ounces So, the silver was not only of a very high percentage in silver content, it was even more in weight than the three ounces marked on the ingot. It appears that International Silver Mint Company lived up to their part of the bargain. Mr. Robert Grabar, who is the companys General Manager, said that they challenged their opponents to produce even one client who was dissatisfied and they could not produce one. The ultimate result of Judge Hagans decision poses grave dangers for freedom of speech in this country. Bob Prestons situation is similar to that of a doctor, who, after warning a patient that he has deadly cancer offers surgery as a solution and collects a fee for it. The news of cancer reported by the doctor was certainly frightening, and most assuredly the doctor profited from telling the patient and finding a solution to his dilemma. Yet, would anybody in his right senses condemn the doctor and enjoin him from further speaking out against cancer?
