It would be impracticable to undertake to review the evidence in detail a. to uie amount of water or that included the flowing amount diverted by the Ogden Water Works, a Junior appropriator, and that diverted by the I'tah Light ft Railway Company, a junior appropriator, and returned to the river below, t which amount on August Srd. 19CS, was 21 second foot) but it suffices to say that upon no theory can the court find that so much as 101.37 second feet or approximately that, l inclusive of the atuoiims diverted a tust elated) waa available on that day in the channel o the Ogden river to reach of the North Ogden the head-gatcanal. "The court must find that they are guilty of contempt of that decree. The evidence, however, show that they probably Intended no contempt of the authority of the court and that will be taken into consideration. "Findings and an order may be prepared in accordance with these views, and the order will be that David Lindsay be discharged, no sufficient reason appearing to hold him. ar.d that George A. Park City, Aug. 16.'The strike at the West' Quincy is holding out well and the ledge gives every Indication of being in place and the ore permanent. An assay of the ore shows 139 ounces of sliver, 18 per cent lend and 81.80 gold. The character of the ore resembles very much that of the Quincy and it la thought by many to be the Quincy vein at depth. Tho presence of ore in one of the new properties in the Bouania flat country means n great deal to this camp, as it has always been the theory of mining men that this section contained some big mines if they could only be developed at depth, lf the ore In the West Quincy holds cut as is expected n great deal of activity will be noticed about the other properties in the vicinity this fall. The work of repairing the engine at the Poly West is being rushed as rapidly as possible, but It will probably be a week before the machlue Is in running order again. In the meantime nil the work in the mine is being carried on above the 900-folevel, and the ore hoisted through the old Quincy shaft. The mill is running three shifts as usual and the output of the mine will not be greatly lessened as a result of the smash-up- . A point has. been,, reached ia the clearing of the cave in the Ontario tunnel, where the greatest care has to be taken to protect ths workmen from the probability of the water breaking through the cave The protection of the lives of the workmen has been the first consideration of the management, and while it retards the work to a degree, it Is thought better to take no chances on the lose of life The tunnel la now clear to a point 5 feet from lie mouth and it ia known that there ere 400 feet of bed ground ahead. How much of this has caved it is impo- - Jble to ascertain, but in nil probability there la a great pile of dirt yet to be removed before the tunnel ie clear. An attempt will be made to drive pipe through the cave in an effort to drain off some of the water which ie being held back and flooding the mine. g a N.2234 Wash- MRS. ADDIE CLARK, ELLEN EASTMAN.
